New job and vacation...

Last June I started a new job, but during the interview process, I told them I had a two week vacation planned in August. I made it clear it was to time off with or without pay, but I had to take it off (took son to school).

They counted the vacation against my yearly vacation and I'm still in the hole by five days or so.

Is it normal to do it that way or would you just have let me take the days and not count it. Several times, people have joined companies I've worked for and went on planned vacations that didn't count towards their yearly vacation.

Thoughts?

I joined my current company knowing I had my wedding 4 months after my start date. They simply did non-paid vacation.

Did they pay you for the time off? If they didn't how can they count it against you???

You can go into the rears at my company, it's very normal in fact.

They paid for the time off, but I was willing to go without pay.

Couldn't not take my son to his first year of university!

Plus it was a vacation we hadn't had in years as a family.

I would expect any vacation that you take while an employee to count against your vaca total. Possibly going into negative days unless you managed to work out non-paid time off ahead of time.

A guy I work with just went on a 3 week trip to Africa. He only had one week of vacation. He took "leave without pay" for the whole 3 weeks and kept his one week of vacation.

Of course it's all a part of the negotiation when you took the job, but I would have assumed you wanted to count the time off against your vacation. If someone came to me and said, "In the first year I work for you I want my earned vacation plus two weeks off without pay," I would have wondered how badly he wanted the job.

What is the companies policy on "use it or lose it"?

Do they have a carry over policy for unused days?

If it wasn't clearly stated before hand that it would be time off without pay, I'd say its pretty nice to work for a company that allows you to go negative with your vacation.

You can carry over unused days, but negative vacation days carry over as well.

It'll be a year from when I took my vacation to when I have another vacation day accrued.

Makes sense.

One of the problems with carry over is staff who rarely take time end up accruing a lot of days over time that are valued at current salary and not at the salary they were initially earned under.

Great for employees, terrible for companies which may be why they counted them as paid.

Mine is a small company and we only carry over 5 days max.

We can sell vac time back but are required to take at least tend days a year off.

At my company you could have taken the time unpaid but you don't accrue paid vacation until after your 1st anniversary. It seems they generously paid the time off and it would logically count against accrued paid vacation time.

I think use it or lose it is based on the state you are not the company that you work for.

Specifically I don't believe you can use it or lose it in California or Oregon
