and have seen far more fences in the wrong place then a corner pipe more then a tenth off now on center-line intersections yes I have seen 3 or 4 in worse cases not talking about straddlers but center points set by mortgage survey guys but quick and dirty was their game I worked for the local county we did every thing from section corners over kill but accurate |

I always beg people who want to reference property corners to use PVC Pipe, it lasts forever and will not interfere with our markers. When I set an intersection nail, I put my disc on it. I also take it pretty seriously, since I typically work in platted General Development communities (Port St. Lucie) we are working with 1960's record plats which are pretty decent. When an intersection PCP has been destroyed we run out all the blocks around it before setting it, then set it once we feel we found what matches the best. I am always amazed when I come back 4-10 years later and find a nail and tin tab slammed into the pavement near it. Of course, not enough balls to put your ID in there just a random tin tab. There is an intersection here, not sure if it a joke or not, I came up on it several years ago, there has to be 10 nails in there. I remembered taking a CE class with a similar picture ( I have to try to find mine) and told the class we were all pussies if we did not slam a nail in there with the rest of them. I have to wonder if that is what is going on here. Quote:

where is the disputed fence ?
the white fence at the rear ? |
Yes it is the white fence in the backyard. I have a double lot (50 feet) so I have two neighbors along the rear property line. The one neighbor just leaned a wire fence with no poles for support against my fence then piled all of their crap against it until it knocked over my fence. The other neighbor had a fencing company cut down the section of my fence behind their property and instal their nice shiny plastic fence.
This is why I want to establish the property line legally, that way I know what I can do. |
so you have a 50 ft lot double divided lot
with 3 points on the rear line 25ft apart exactly if undisturbed no real Ca knowledge but 25 ft lots should be plated and your structure should be building permitted with a plan on file with the city joker is if the rear single story bit is on the original plan or an add on the quick way with no digging [but I would dig the three points ] is get the building plan and measure from the building corner to the fence line your local public works or building dept should have the plan |
Lots of problems here, you had a fence, they had a fence, everyone thought it was ok, but now maybe not.
You might find the same corners the people did that put up a new fence, if they found any. You still won't know if they are correct or not and no court is going to do anything for you without a survey. |
This is the most devious and brilliant idea I have ever seen. I am stealing it to use when I have clients that want me to survey land in order to fight with an ahole neighbor.
Thanks. I learned that at a Continuing Education Seminar. I paid a lot to attend that seminar.:D |
