"Obama's Blaine Amendment"
Another era when the government punished Catholic institutions.

As outrage builds over President Obama's mandate ordering religious hospitals and charities to cover contraception, the most arresting analogy to date comes from our occasional contributor, Richard Land.

"This ruling by the Obama Administration is the most transparently anti-Catholic action by the federal government since the Blaine Amendment was proposed in 1875," said Mr. Land this week on his national weekly radio show.

The Blaine Amendment? Well, yes.

That's the amendment that would have altered the U.S. Constitution to bar the use of taxpayer funds to finance "religious"—that is, Catholic—schools. Republican James G. Blaine pushed the amendment when he was in the House of Representatives amid the wave of nativist opposition to immigration from Catholic parts of Europe. Blaine narrowly lost the 1884 Presidential election, during which a Protestant minister famously described Democrats as the party of "rum, Romanism and rebellion."

The Blaine Amendment narrowly failed in Congress, but it inspired copycat efforts that succeeded in many states. A version of the amendment is still part of several state Constitutions, and courts have used them in recent years to strike down voucher plans that include private religious schools. Few of the liberals who invoke the amendment now understand its bigoted beginnings.

Mr. Land's demarche shows how dramatically America's political fault lines over religion have shifted. As head of the Southern Baptist Convention's Ethics and Religious Liberty Commission, Mr. Land is one of America's most influential Protestant leaders.

A century and a half ago, many Protestants joined in using government power to punish Catholic institutions. Today, they realize that the main threat to believers of all types comes from a government that would use its power to limit the free exercise of religious conscience. Mr. Land is right that the true heirs to the Blaine Amendment now reside in the White House.

While I do believe that this immigration power grab is at such an unconstitutional level that he could be impeached, I doubt that he could be removed from office.

clinton was impeached. it didn't get him out of office. and it isn't 'easy'.
