That’s because the ban blocks focus more on campaign rhetoric than constitutional law, Dershowitz continued.

“Focusing so heavily on campaign rhetoric and essentially saying, ‘look, if Obama had issued the very same order with it would be constitutional, but if Trump issues it it’s unconstitutional because he said some things about Muslims in the run-up to the campaign or Rudy Giuliani said some things and other people said some things,’ that’s not the way the law is supposed to operate,” Dershowitz explained.

Dershowitz said he believes the Justice Department under Trump is “getting smart,” as it is not filing its appeals to the Ninth Circuit court district, where it will likely get an adverse ruling, but to the Fourth Circuit, a “much more conservative court” that would be more likely to uphold the travel ban.

And if the case makes it to the Supreme Court, Trump will likely win his case, as the vote would be split 4-4, said Dershowitz.

Meanwhile, Dershowitz said he believes the courts, in ruling against both of Trump’s travel bans, are performing psychoanalysis, not constitutional analysis.

“There is precedent in extreme cases, where legislators in an in enacting a statute say things that you can look to the legislative intent,” said Dershowitz. “I have never heard of a case where the rhetoric of a candidate, ambiguous rhetoric to be sure.”

He also said he does not believe the ban is a Muslim ban, but rather focuses on countries like Iran, “the greatest exporter of terrorism.”

“Not only no vetting, but it sends terrorists out in order to kill Americans,” said Dershowitz. “Iran has so much blood on its hands of Americans and American allies, to exclude a country like Iran from the list would be absurd.”

Our lib friends here think Dershowitz is wrong and 'out of touch' let's hope they don't apply his logic to the Dem party and continue to go further left as they appear to be doing.

Dershowitz hasn't really been a dem since about 2010 - he started to endorse GOP candidates around that time.

The judicial block on Trump's ban focuses on intent. Obama's ban went after a specific country (Iraq, which oddly isn't on the 'new' ban) after a specific threat was found, a world of difference.

The Bowling Green Massacre would have still happened even under this newest 'ban' from Trump.

Obama didn't go around rallying the masses with speech after speech about how he was going to ban Muslims.

The problem on Trump's ban was caused directly by him and his minions. If they didn't brag about how they found a way around calling it a Muslim ban, even though it was a Muslim ban, or stated that the new one is just Muslim ban 'light' and will end up doing the same thing, maybe the courts wouldn't have any 'intent' to throw back at the administration.

Some day this administration may learn that words have consequences, but I am beginning to doubt it.

The travel ban is just the first attempt (second attempt) at banning a religion which embraces a theology of world domination and subjugation of non-believers and women.

This evil has been around for 1,400 years and occasionally rears up it's ugly head.

It's been rearing up it's head since about 1996 in earnest (Bin Laden's letter to America).

It has never just gone way by it's self or burned it's self out. It has never progressively reformed it's self from the inside either. Please feel free to correct me if you have evidence to the contrary.

It took hard fought battles and brutality of equal measure to their own to defeat and qualm.

Right now this smoldering fire is being feed oxygen with the influx of money. The money stems from oil sales which come from Saudi Arabia, the financier of Wahhabism.

Why is not Saudi Arabia on that ban list?

kach, the Q is, does a sovereign country have a right to defend against enemies IF that enemy has a common 'religion'? ...and a 'religion' with the stated goal of converting or killing all non-believers.

IOW, should a place of Freedom of Religion allow a 'religion' which is (violently) contrary to the concept of Freedom of Religion ?

I took yesterday away from PARF to help certify a flock of wanna-be PCA National instructors. I realize many off you wait with baited breath for my every pronouncements, and that you were active on the Muslim ban issue over the weekend. I'm sorry for your distress, but now I'm back.

As to Dershowitz: Smart lawyer, interesting argument, but I don't think it works. It ignores the second part of the test if animus is not found. So, if the law is not intended to discriminate illegally (animus), does it nevertheless do so unintentionally? If the answer to the latter is yes, the law fails. Dershowitz is a showman (he defended O.J., who was innocent, right?), and has made a great career out of these types of arguments. We'll see if he's right.

As to C-B's argument: The rulings on the Muslim ban have not been made by a few out of control liberal judges. The judges who have struck it down have been from across the political spectrum, both Dem and Rep appointees. They are not members of a "liberal activist judiciary," they are judge doing what judges do. As to the 2A argument, it is a perfect example of America's choice to be less safe in our persons (U.S. gun violence is ridiculously high in comparison to any other civilized country) in exchange for reserving our right to bear arms and defend our liberty from tyranny (a quaint and outmoded concept, originally written when armed citizens had a chance against similarly armed government). We accept the danger in exchange for liberty. Other countries want the safety of a disarmed populace. They are a lot safer, but a lot less free.

As to the calls to remove the judges--for what, exactly? One side is always unhappy with the outcome of cases like this. If we start removing judges because they make one party unhappy--especially if that party is the executive branch--we quickly destroy our constitutional form of government.

I always just skip over the stupid cartoons and memes people post. They are a substitute for actual thought and analysis by people too lazy to do their own work.

OK--I have to get back to making America great through the engine of my small business. You'll have to somehow get through the day on your own. Rave on.

His order will prevail in the end.....no matter what was in it (as demonstrated by this second challenge of a straightforward document) it would have been challenged by some lib somewhere on made up grounds....as is going on now.

He is trying unlike his predecessor who had the exact opposite outlook....Obama was raised a Muslim and had a child's understanding and outlook of the religion.

You are mixing the two dif bans as to what judges did what....the most recent event are lib judges making a spurious case.

As to 'animus' would one not have to have a sweeping order that actually included a great number of countries of Muslim majority persons....not just countries we are at war in or have no viable government...or that are major terrorism sponsors.

There are 40 plus countries that are majority Muslim and the vast majority of Muslims live there and can still travel here.....where is the animus?

These countries on the ban are also the same indicated by the prior admin as special interest for vetting.

This can't honestly be called a "Muslim ban" when not every Muslim is prohibited from entering the country. The judge ruled based on ideology more so than by law or the wording of the order itself. If Muslims can still enter this country, which they can, this can't be called a Muslim ban regardless of Trump's words on the campaign trail.

I have to agree with Dershowitz. They can't display that this temporary ban violates the constitution.
