No, that is not what custody means. I know you don't like it (and I don't either re speed enforcement) but they will nail the owner. If you doubt what I'm saying try fighting one with your legal theory.

So the driver is responsible, not necessarily the registered owner. Someone has to place the owner behind the wheel for him to be liable.
I bet the law requires that the owner provide an affidavit that he was not the driver, and that the driver be named in the affidavit. Otherwise the owner is responsible. Similar requirements apply to such things in Illinois.

They're bringing the cameras to Houston, and the city is going to issue civil fines against the owner of the vehicle. They are not going to issue "tickets," which are quasi-criminal citations. No need to know who is driving.

There is a difference between not being in custody and not being the driver. You can be in custody of the vehicle even though you loaned it to your neighbor. If the vehicle was sold or stolen, or if it is at the repair shop, you're not in custody.

Just guessing at this, BTW...
