I keep seeing their commercial today... annoying song "This is howww lifeee should beeee"
that sucks. |
yeah around 19,000 to have it fixed correctly.. progressive wanted to use body filler and repair the damage rather than replace. Their est. started at 6 grand to fix everything.. and then went up to around 11,000 and the claim lady sent that in and they said total the car out.
not only that but you wouldn't believe how many people told me to go away becuase they just don't deal with progressive.. |
i want to get this resolved before the 13th of this month, because that is when my next payment of 360 something to them for insurance.. and they are done after this is resolved.
|
Given the circumstances, I think I'd get some documentation showing the estimated value of the car before the damage in the 16.5-17.5K range as well as the value of the car now showing something in the 3-4K range based on doing the repairs corerectly.
Then call them up and say...I think its worth 18K, you think its worth 15K...lets compromise at 16.5K. You say the salvage is 5k I say 2.5K let's call it 3.5K. Gimme 12.5 and the salvage and this will be over. Here's somke documentation to help you document your claim file. With no frame damage and running/driving I can see where they're comming from on the salvage....that PLUS they know you want the salvage. If they don't bite tell them you'll have to talk to a lawyer about those words insurance companies hate to hear "BAD FAITH REFUSAL TO PAY A LEGITIMATE CLAIM" Good luck. Oh yeah...you going after the third party vandals (or do you know who it was?) |
Yeah, i'm going after the people that did this.. i have an idea of who did it.. adn the case is strong.. could that be another point i should bring up to insurance company that they can go after the guys and get their money back.
|
if the insurane company is not going to pay the market value of the car then you should be able to prorate the salvage based on the percentage of the car value that they will cover. My car got flooded with saltwater from hurricane Katrina. I was able to get progressive to waive the salvage buy back on my car because the stated amount policy was not nearly as high as the value of the car. believe me it was not easy and it took about 6 weeks but I finally got what I wanted.

I'd heard here that typically one pays 25% of the assessed value of the car to buy it back. That would be $3750 in your case. |
Well i have a couple of phone calls into the from yesterday and no word back from them again.. so hopefully today i can hear something worth of good news..
|
I don't get it. You're expecting them to do what? Hand over $18k and then sell the car back for a few hundred. No offense but I can see their position here.
I'd take the $11k, source the parts, mount them and have an experienced body guy refinish. You'll be well ahead. |
I went through relatively the same scenerio...Here's what I did after 6 weeks of negotiating the value of the car.
Pulled my 16x9" fuchs, and replaced with oem 8's. Pulled the momo steering wheel, replaced with beater OEM that I purchased for $20. Pulled the Fabspeed ss 1 in 2 out sport muffler. replaced w/oem Took my tool kit. Took my tire compressor kit. By doing this, and selling the items here and on ebay, I netted $2K more than what the ins ba$tards were willing to give. P.S. I did negotiate the price up from their original figure before notifing them that I was pulling parts that were not originally on the car at the time of letting the policy. Fuch em! |

I had much more invested in the car than the $18,500 they offered me so I decided to buy it back. They valued the wreck (calling a couple of dismantlers) $4,500. So I will receive a $13,500 check (18,500 - 4,500 - 500 ded). |
sorry to hear of the problems, word to the wise everyone should check their policies and make sure they have "agreed to value" coverage. Hagerty policies have this (no connection) when you say the car is worth X that is what you are paying for and will get paid out when you have a loss.

The hassle you are having to go through sucks. You have received some excellent advice above and hope it works out.
One piece of hollow satisfaction you can take away is that others (like me) are checking, and changing their insurance. I just raised mine 15K and made sure is was Agreed Upon. Sorry this had to happen. Keep us posted on the result. |
I have to agree with Kurt, at least in the continental US, $15 for a 1978 SC is a fair amount.
As for getting a lawyer to get the insurance company to be fair: I went through this and got my money (after a year and half and $3-4K of lawyer's fees). My insurance company's basically wouldn't do anything until they had a gun to their head legally speaking. A letter from your lawyer won't do squat. They also don't care about the facts of the case or if you are legally in the right so don't think that "proving" you are right or explaining what happened or even showing them what the true value of the car is will make a difference. -Chris |
I think its more along the fact that kind of feels that i was robbed.. you leading to believe that i was paying towards this dollar amount for insurance and not getting that amount in the event of the car being totaled. I know what the market is for sc's.. hell if i told you what i paid for the car, you would tell me to shut up and quit your crying.. it more along the principal behind it. And they do this to everybody, everyday. I mean there is a guy there that gets paid to basically cut every penny possible and take as much money from you as possible. so **** the MAN... I'm going to try to get as much possible.
by the way, I love this board and all the comments i have recieved. .you guys have been great.. thanks so much for the info and the advice towards this matter. I'll keep you guys posted.. |
Well its finally over.. and about time i might add. I got 18k for the car and 5k to buy it back.. minus the 500 dect. and pocket 12.5 for the car.. so all in all i got what i was asking for in the end. Thanks for all your guys advice and words of wisdom.. Now its time to fix her up.. i'll be posting pics as the work starts to progress... thanks again
