If you read the fine print, this is a CD of *LINKS* to the information on our site, so it doesn't really contain any copyrighted information.

Whatever. From my point of view, as long as he is not copying information from our site and modifying it in any way, then it can't hurt me. The only suckers are the people who bid on it, and then find out that it's all available for free.

So, it is a list of links to our site, so the people who are buying it will end up here anyways...

Hmmm....

The worst part is, that there is a great possibility that he/she is a member of this board. If he is ripping off people on EBay who says he won't do the same here.

Too bad I wasn't some sort of hacker and could find his IP adress and find out who he REALLY is.

1. The right to cancel any and all bids suspicious of fraudulent activity. This includes copy and re-distribution.Talk about the pot calling the kettle black!!

2. To only accept bids from members that have a feedback rating of 10 or better.He has a feedback of ZERO!!!!

3. To olny accept bids from member that do not have a mask associated with their ID.He has a mask after his name!!!

4. To only accept bids from members that have recently sold items on eBay.He's got a zero feedback rating, apparently he hasn't sold anything at all!!!

Gonna go against the stream here... here goes.

If he is just selling a CD of links to technicle articles and such, I think that's ok and can actually be useful to alot of people out there.

It's very convenient to have a link for each project.....ok, I want to do valves, I go here, if I want to change brakes, I go here...etc, fast information!

Think of the time you'll save trying to find all these link locations yourself!

It is available for free but how long will it take you to get all those links yourself?

This is similar to buying a book of directories, whatever that may be....

Emmanuel, although I think his Auction Terms are hilarious and the ad in general is somewhat deceptive, I agree with you completely. He certainly has a right to sell his links. On the other hand, if someone wanted all my Porsche links from the last few years I'd just give them away. -- Curt

If you guys really want to find out who he is , bid then go to the ebay home page scroll down on the left it will say find seller put your auction number and stuff in and ebay will send you his home address with telaphone number, Kevin

Somewhat of an analogy can be found in "deep linking" (having a link on one site that leads deep within another site, thus bypassing the home page and much of the branding). There is some case law related to this:

On March 27, 2000, U.S. Judge District Judge Harry Hupp issued a ruling dismissing four counts of Ticketmaster's complaint, including some counts involving deep linking. In dismissing the first claim, which alleged copyright infringement, Judge Hupp stated: "[H]yperlinking does not itself involve a violation of the Copyright Act (whatever it may do for other claims) since no copying is involved. The customer is automatically transferred to the particular genuine web page of the original author. There is no deception in what is happening. This is analogous to using a library's card index to get reference to particular items, albeit faster and more efficiently."

But, the Gigalaw article concludes:

In the majority of the instances of deep linking -- where there is no confusion as to source, where the user knows he has been transported into another site -- is deep linking always okay? Probably not. It is highly unlikely that a single, short opinion on a motion to dismiss will conclusively determine the issues involved in deep linking. The concerns expressed in Ticketmaster's October statement regarding deep linking have merit. Much as in cases involving such issues as framing and meta-tagging, issues of fairness will inevitably factor into the resolution of the deep-linking dilemma. Factors such as the status and motives of the linking site are bound to enter into future court decisions.

So I guess you could try and guess the motives of our little friend. If his links go to the home page of each source, then I think there is no question he's in the clear. If they go directly to each source material page, then he's in a gray area.

Aw what the hell...why be charitable. Can Leland get us another one of those smart bombs?
