How can you guys think he "mistakenly" thought it was a five speed? He represented how it shifted ("The trans was always smoothed shifting never any popping out of gear") so either he had first-hand knowledge of how it worked, making it a little hard to miss the 5th gear, or knowingly lied about his (non) use of it.

Either way, he doesn't have a leg to stand on.

If it's now a freshly rebuilt transmission, probably best to just install it into a car and drive it.

We only have half the story here, and the only parties to benefit from sussing out the truth (if it were even possible) would be the rest of us Pelicans, assuming we also identified the seller.

In any event, I think you have to give some accommodation to the seller. He's taking a risk accepting a return of a product which has been modified after the sale, and he has no way to vet the work. Or, he's taking a risk offering a refund at the say-so of the buyer, with no input on the costs (real or imaginary) incurred thus far.

Fairness is a two-way street.

If the OP was still upset I suspect after 2.5 months HE would have bumped it. He didn't. Some random noob did. I'm just say in.
