Sway-Away spring plates-EBay purchase
I bought a set of new Sway-Away adj spring plates on Ebay. (at this risk of being an off topic)....The seller wants me to pay shipping, plus $20 California sales tax.
Do I have to pay CA sales tax if I'm not a CA resident, or is this guy just trying to get an extra $20 out of me? Nick

As I recall, you only have to pay Sales tax, if
1) The seller and buyer are located in the same state. 2) The seller has a retail location in the same state as the buyer (then the buyer would pay local-state sales tax) Good luck fighting this though. I suppose it would help if you could find some documented sales tax on the internet type information - Ask Ebay for some help. Good luck.

Gennerally, no sales tax if the product is shipped out of state. I don't know CA law, but Wayne doesn't charge sales tax on those items that he ships to VA, so I will assume that Wayne is following the law. Therefore, sale tax only applies if the product is sold and received in CA.
I think that he (the seller) may not know the distinction. (I always assume the best in people) I would e-mail him and question the sales tax, and back out of the sale unless the E-bay page said that all sale are subject to CA sales tax.

Sales tax is not owed on out-of-state shipped items from Ca. If he tries to back out of the deal because you won't pay the tax then inform him that you will report him to ebay and leave negative feedback as well.

I've run into this before; 9 times out of 10 it's someone trying to scam an extra n% on a sale.
Ask him for his Board of Equalization #. Every time I've asked for it, the tax issue disappeared into thin air.

This person is trying to squeeze you for more $$$...you are in Italy, he should be charging you VAT not CA sales tax!
Tell him you dont think its right. Did he state in his auction info that everybody has to pay sales tax? If not, back out of the bid, if he gets nasty and leaves you bogus negative feedback, turn him over to ebay police! Good luck, I hate kooks like this that try to rip people

you shouldn't have to pay sales tax. i recently bought from the same CA vendor (ebay search under completed items revealed seller). he has a very stand-up business. i'm a ca resident and he didn't charge me the tax though his auction stated there would be a tax. hopefully there is a miscommunication that will be resolved. please keep us posted. bob 68L |

Thanks guys. I had sent an email to the seller, but it took him 3 days to respond to my last email, so we'll see. .....but good news to hear Bob had a good experience w/ this seller. Sorry Wayne for not buying from you....couldn't pass up a good deal....I'll get the bushings from you.
