New york State title experts needed
I am not sure if I post this on the right forum.
I purchased my car from a guy who used to owned a garage. He had a lien on the car , did all the paperwork properly but never send them to DMV for title. The papers are dated 1997. I have all the original papers including a Garageman bill of sale from him to myself. I called a title service agency in Albany, asking them to review if all are correct and ill send them the originals for processing. I was told that I have to send them the originals, They will not review copies (sounds fishy to me ) these are my only paperwork and I don't want to send them out and get caught in a fiasco. I was also told that DMV may not honor them because they are dated 1997 I don't know how to proceed, I am sure some of you have been there. anyone with experience, Please help! |

Take all paperwork and go to local DMV. Go over it with them. They will tell you what is missing

Sounds a lot like my current title situation... Take your paperwork to the DMV and they will walk you through the process to obtain a title. For me to do so I have to have a court order and go in front of a judge to prove ownership and they can give the right to issue a new title. You will need to have a bill of sale that shows you purchased it as well as an officer to come out and run the VIN to ensure it wasn't stolen or anything of the sort. DMV will help you with all info needed. Take what you have to them and go from their

The above post is correct if my memory serves me. Expect all this to take a long time. Ask a lot of pointed question to try and be prepared for everything they want you to have and do

Can you get a notary public to sign copies of the originals? Maybe even go to a lawyer or courthouse to verify the copies. Not sure what the DMV can say about that. But then we are talking about the DMV...

There is a gentleman here on the board unobtanium-inc, I believe, who buys and sells a lots of old Porsches, and is in NY too. He's probably seen everything. Perhaps he can advise.

In times past, NY wasn't even a title state, everything was done on the registration.

As far as I know regarding NY titles you have an issue on your hands. If he never filed the paperwork to execute the lien then he is not legally the owner of the car and cannot legally transfer ownership to you. He would have to obtain a proper title to the car and then transfer that title to you. Good luck at the DMV ask 4 different people there and get 4 different answers. As stated above hire someone who works with titles and let them handle it. Ask your insurance agent if you have one they should be able to help you.

Take out a life insurance policy so that when you die of old age waiting at the DMV you will at least be comforted knowing you've provided for your loved ones.

Skip the DMV and go to Broadway title and pay the $800 and get a new title. If that's not an option go to a rural DMV office in NY. Forget Long Island, Albany, et you'll wait in line half your life, then get sent to the back to fill out another form, then get five different answers from five different supervisors, then go home with nothing. If you can't do it through Broadway or other title service sleep with a DMV employee for a few months That always works.

As Mike said I think you may have a problem because of the lien. But I sold a car a few years back and gave the guy the lien release and he had no problem getting a title. Also there is a DMV in Riverhead that I have been lucky at usually in an out in a 1/2 hour. Bring all your info with you. Good luck.

Do you have a title with a lien on it?? If you do and the paperwork releasing the lien you will be able to get a title. But it will take longer than if you had a clean title. They should still register it for you though. It usually takes a month or so to get the title. What year is the car?

I don't have a title , I have the lien papers that the shop processed 20 years ago . I have all the docs but he never applied for the actual title.

New York still doesn't issue titles on cars older than 1972, so let's start with the year of your car. I'm in Long Beach and have gone through all sorts of title issues in NYS. PM me and I'm happy to help.

Great news!
after reading everyone's advice , I decided to get the car insured, fill out all the paper works and headed to a small DMV office out on the island. I submitted the paperwork and she says " uh, you didn't complete the process" I told her, well the only thing left to do was to apply for the title, but since NYS don't issue a title for pre-73 cars, it didn't make any sense. I waited until I am ready to register. She replied " not a problem" She issued me the tags and registration. The registration says "not transferable" she explained to me that, once Albany gets the original papers they will send me a transferable one within 3 weeks. Great thanks to all of you. |
