AGL = means above ground landing
as in altitude above ground, not sea level.

Absolutely. Just no different from a bad car crash where people die, IMO, someone either messed up momentarily or a horrible mechanical failure happened at the perfect wrong time. Not to be confused with someone driving 100mph drunk, etc...
