Legal advise on residential lease?
Hey there fellow pelicans...
I have a question on leases. My Fiance had a lease for her old apartment but it states at the top that it is a "Commercial-Idustrial Lease for single tennant property" There were 2 other girls that signed similar leases for the same property at the same time. Can the Commercial-Industrial lease be used for a residence in Indiana? She has been moved out for 4 months now, gave her landlord notice that she was moving out, and paid 2 months of rent AFTER she had moved out of the property which was agreed upon. Now he is trying to file a lawsuit for $2300.00. Thanks for any info, Nick

Doesn't smell right. A proper residential rental lease will protect the landlord and spell out the rights of both parties. Any part of the lease which contradicts Indiana tenant/landlord law will be thrown out in court. A judge might throw out the lease, but I would not count on it.
Why is the landlord filing suit, and why did your fiance pay rent two months after leaving? Did she break the lease? If so, did your fiance and landlord make an agreement? Is that agreement in writing? Documentation is critical. Regards, Jurgen |
