Does a SPAMer get more time in prison than a rapist, murderer, drunk driver, or armed robber.

Only in America are people more pissed off about receiving junk email than someone trafficking drugs or shooting people.

In case you're wondering what prompted this, 2 prominent, although small time, SPAM e-mailers have been arrested and are facing up to something like 60 years in prison, each. Violations of CAN-SPAM Act + Money Laundering. Ok, I agree, Money Laundering is a No-No, but that much time? These guys could have shot some people up for drug money and faced less time!

Oh yea, they were on America's Top 10 Most Wanted! For sending ****ING E-MAIL! ARE YOU SEROUS?!?!??! WHAT THE **** PEOPLE, THERE ARE BIGGER PROBLEMS THAN YOU GETTING EMAIL YOU DON'T WANT!! PULL YOUR HEAD OUT OF YOUR ASS!

Maybe the rest of the world is right...America is going to hell in a hand basket.

I'll link to the story/stories later in case someone wants it and can't find it.

*In case someone wants to lecture me on how much SPAM they get, in a one and a half month period, I received approximately 6,000 SPAM messages. I ***** about it a lot less than anyone else I know.

Good. I could care less if their sentence is more or less than criminal "B". Lock their sorry asses up and throw away the key. I hope they rot in prison.

Any particular logical justification why white collar criminals should get 2-4x the sentence of hardened killers?

Sure it does. Seems to me like present day America (or at least the Judicial System) values the time/inconvenience of consumers using a system that was never designed for them, and money the IRS didn't get, over peoples lives. And hell, after the assets are frozen and all that jazz, the IRS gets their money anyway.

So basically the Justice System is saying....that the time it takes you to delete a few SPAM messages is worth 2 or 3 lives.

I think my ex-girlfriend started a SPAM operation. Most of those 6,000 emails contained the subject line "MAKE YOUR PENIS BIGGER" or "SIZE MATTERS, GET BIGGER NOW" or "HAHAHA WHY IS YOUR RAMROD SO SHORT!?!"

In all seriousness though, spam IS criminal. It costs businesses (and individuals) billions a year in lost productivity, required upgrades to network infrastructure, etc. It's not benign and not just a prank. Any parallels between it and simple "junk mail" is incidental at best. Next time your 4 or 5 year old kid starts getting ads for Viagra, "get a bigger dick", "lots of XXX passwords" or other crap, I doubt you'll think it's so benign also. . .

I don't look at it as trivializing a violent criminal's sentence, I look at it as "hey, a piece-of-schit spammer got the book thrown at them. Good". It's all in the way you look at it. Yes, I'd like to see the murderer/rapist get an equal or greater sentence, but if the alternative is not nailing the spammers at all, I say it's better than nothing and sock it to 'em.

Jeff, I hate spam. I run my own mail server from home and use spamassassin to send it to /dev/null. I am not as diligent as I should be, with updating the software, so I still have to deal with plenty of quadruple spams.

I was so livid one night, that I tracked one down and called him. I thought I was going to get an answering service (was at night), but it was his cell phone. I let him have it and he gave me every contact that he had for his spam lists.

Good times!

Nice, I don't remember who, but someone here on the board had a spammer once that he really screwed to the wall. The spammer sent an email that came from an address that was in the correct domain, but when you emailed that address it had an autoresponder that said don't email this address, so the Pelicanite set up a rule in his email to auto reply to the spammers auto-reply. I think he said that after 24 hours the CEO of the company was calling him begging for him to stop his rule. I REALLY love that story. It's just unfortunate that the same thing wouldn't work for 99.99% of the SPAM that we get these days.

Take your situational ethics home, you obviously have some kind of personal interest here.

Crime is crime. There is a price to be paid if you get caught. Just because they didn't have a pistol in their head when they robbed people does not make it better.

I suppose your going to tell us that elderly folks who get ripped off in phishing scams 'deserved it' for being stupid?

There is this odd concept called SIMPLE HUMAN DECENCY, perhaps you should look into it.

Hmm. I think I'd like to say something here.
I'm currently involved in the Federal case against Robert Alan Soloway. I'm a witness for the prosecution. Soloway spammed us so bad, it nearly put me out of business. Crashed my PC. We're talking non-stoip spam and joe-jobbing for months. We got 100's of 1000's of returned emails because our email address was used.

Between my wife and I, we EASILY get over 1000 spams every - single - day.

Spammers write viruses and/or hire virus writers to infect computers. Spam causes billions of dollars in loss to business every year.

Spam currently makes up over 75% of all email every day.



If murder we legal, I would go hunting without remorse.

Instead of making penalties lighter for spammers, how about actually punishing murderers, rapists, and pedophiles? There, I solved the debate.;)

I haven't been murdered lately, but I get spam every day. Therefore, it's a worse crime because murder is what happens to someone else and spam happens to me.

That, of course, is simply an over simplification on such issues. Ask any sensible person what is worse and there won't be a single person who seriously thinks spam is worse than murder, etc. But, spam affects everyone every single day so it's bound to get more attention.

Btw-Who thinks we're going to hell in a handbasket and for what reason? Anyone I've talked to not in the US refers only to the war, not our justice system, let alone our spam policy.

I agree with Slow. Let us for argument sake assume 60 years in prison is reasonable for sending SPAM the way they did. In my book that would give rape, physical assault and murder at least 600 years. I can not understand how sending SPAM could be worse than beating someone severely with a baseball bat.

This is however not only in America. In Sweden we often see a higher sentence for economic crimes than for physical crimes. Personally I think it is absurd. If someone beat my 11 year old daughter up badly they should not have a shorter sentence than a guy robbing a bank without physically hurting anyone (or sending SPAM for that matter). The perp of my daughter should be hacked to pieces with a small pen knife. Slowly bleeding to death while suffering terrible pain. I am ordinarily against death penalty but this got me going. :D
