Legal question

I just found out about something that happened to my in-laws this morning.
It seems a gentleman traveling at what must have been a high rate of speed, lost control of his car, wiped out a fire hydrant, traveled about 80ft across their front lawn, up the 4 steps to their cement front patio and then into their living room. Luckily the alcohol and drugs helped prevent too much injury to the driver, and he was nice enough to remain passed out on their front lawn until the police arrived.
It also appears that the driver was not burdened by anything like auto insurance, so what do you think would be the best approach for them at this point?

Contact their Homeowners Insurance carrier and an attorney.

Turn it over to their homeownwer's insurance company and let them pusue him after they pay the damage. I'd guess he'd be judgment proof.

What those guys said. It is probably not his first DUI offense, I would bet big money on it.

Tell them to take plenty of pictures, keep track of ALL their expenses(time spent to go get plywood to board up windows, etc) They need to keep a written record, dates included. It will make things easier later

Yeah, I'm not worried too much about their insurance, I would just like to know how they can go after this guy and actually get something.

He has to have something for you to get something. All he probably has is a wrecked car full of empty beer bottles, guess you could get the deposit on the empties.

That is why they call losers judgement proof. You can not get blood from a stone, or money from a drunk with no assets.

Probably not. He may or may not get convicted, but I'm guessing he doesn't have anything worth taking and is therefore "judgement proof". Either way, their insurance company will be the ones to decide to pursue that.
