In Va the key to DWI/DUI is actually the .....keys. The keys just need to be IN the ignition to convict, The engine doesn't have to be running, or in gear, or You in the drivers seat.

Same here in Washington. The car can be up on jackstands in your garage, and if the keys are in the ignition, you can get a DUI. Unlikely, sure, but that is how the law is written. Hell, you can get a DUI here while riding a bicycle.

Well this weekend we are all going out to celebrate. And no we aren't being dumb, I'll have a coke with him while everyone else get's stupid. I actually don't mind being the DD. First time in my life that I feel somewhat mature.

worked with a guy many years ago that had this experience.

drunk off his ass riding his bike on a busy resort road (think the strip in vegas) and ran smack into a cop car that was parked while the officer was writing a ticket.

told the nice lady cop to mover her 'effing' car and got the cuffs.
