Just want to add a twist to this because I've seen it happen more than once.
We all agree that road debris that is kicked up and causes damage is not the fault of the vehicle that causes it and the insurance companies agree. However, I have witnessed, several times, situations like this: On the I-5 and I-405 there are car pool lanes that, in places, are separated from the regular traffic lanes by painted "islands" that are 10-20 feet wide--as wide as two traffic lanes. One of these wide areas is where the carpool lane approaches a flyover. As expected this "dead" area between the painted double lines of the island accumulate lots of debris--not necessarily visible debris, but bits and pieces of dirt, rocks, and gravel. When I've witnessed drivers illegal leave or enter the carpool lane by crossing the islands, there is always a visible cloud of dust/debris kicked up. So my question is, should this happen and your car is damaged by the illegal actions of the driver, is this still considered a "road hazard" or do we now have a liability issue for the vehicle which kicked up the debris? |
not even a blip on my radar. i kinda think my windshield is a service part of the car. it will get changed out, plugged, etc multiple times.
i do think it is absolutely insane when a fist size rock that was wedge between the tires on a rock transport truck gets fast pitched on the freeway. then they pay...they need to inspect for stowaways when they leave the quarry. |
I was on the bike on Sat., doing about 65 mph when the car in front of me threw up a rock about the size of a golf ball. I knew it was gonna hurt and took evasive action. But it whacked the aux. light on my front caliper. Whacked it real good and knocked it out of adjustment by about 30 degrees. But it still works and the lens wasn't broken.
I don't think all states have the no deductible windshield replacement. AZ does, but I had never heard of it before I moved here. |

If you can get the licence plate number of the truck and give it to your insurance company, chances are you will get a new windshield for very little co-pay and they'll go after HIS insurance for it.
Last time I got my windshield replaced (2 months ago) they asked me when and where it got broken and if I suspected any other vehicles were involved. I told them I had no idea, just noticed it was cracked one day. it cost me less than $100 to have them come to my house, would have been almost free if I went to their shop. |

One of the things that peeved me was that the guy was a left lane squatter and he was impeding the smooth passing of people following the *drive in the right/pass on left* rule, which is actually a law. I adhere strictly to this on the interstate where it's a combination of truck traffic and cars. The semis follow it religiously, so it's really dangerous when others do not. He kicked up the rock when he crossed in front of me to exit. My feeling is that if his tire kicked it up, tough tuna fish. If he had loose gravel on his truck, different story. |
