Aside from commenting on the item up for auction, in the U.K. buying and selling ivory over 70 years old is still legal. In the U.S., the rules are stricter, with several variations which makes it very difficult to sell. However, it can be done, legally.

From what I see in the link, that piece would be legal to buy/sell in the U.K. and, most likely, in the U.S. as well if there is documented proof of it's age and authenticity.
