Elderly losing everything

I read this article last fall but with the recent threads on Powers of Attorney and Wills with sketchy family members I thought I should pass this along.

The article covers an unscrupulous woman who gets court appointment as guardian of elderly folks and takes over their finances. The typical MO is to move the family into crappy quarters and have them break all contact with family. All legal and court supervision seems to be lacking.

If you don't feel like you need a bath or want to punch someone after reading you may need to have your pulse checked.

Its from New Yorker, so there are a limited number of free views you can have w/o a subscription.

It would not be possible without degradation of family ties and caring friends.

Apparently there is some collusion with "human services" folks and some of these elderly are getting railroaded into this - There are "guardians" with control of hundreds of folks assets.

It certainly looks like an elaborate con backed up by the power of the state.

Not denying that.

It would be far more difficult to not have this get out if not isolated.

I posted about this back when the article came out.

http://forums.pelicanparts.com/off-topic-discussions/972584-legal-guardianship.html

Basically these people find victims with large assets, move them to crappy nursing homes without the knowledge or consent of their families, and drain their assets by paying them selves large fees to serve as legal guardians. If someone happens not to die before their assets are drained, they are dumped on the state as indigents. It's apparently a regular cottage industry in Nevada.

Ooops. I couldn't remember where I saw it, even did a search. Sorry.

And apparently I couldn't remember that I replied to your thread. Sorry again.

The last few days of threads got me thinking about this again and my blood started boiling all over again.

I searched for disposition of the criminal cases but there does not seem to be any yet. April Parks was placed in jail after fleeing Nevada, but beyond that its hard to tell if any cases are final.

I did find a video with Rudy North speaking after this entire event. Nice to put a face to that name. Heart breaking.

Thanks for this important topic/thread.

Wouldn't happen to my Mom because her son stays in touch with her every day. Phone call...email....visit.....every day.

Call yours today, please....

Absolutely not true. Read the article. In most of the cases, neither the conservatee(s), nor their family, has knowledge that someone is trying to put them in a conservatorship until the conservator shows up at their door to move them out. In one of the cases, the conservator denied the use of a phone and their family, who lived nearby, had no idea what happened to their parents for several weeks...

My wife is her mother's legal guardian with full financial powers, etc. since we were worried about this. Her mother has a sizable estate and is sliding into home-plate without all her mental faculties.

Any transaction about $250 is flagged, stopped and a message sent to my wife. I had to threaten two after market car warranty phone solicitors after they sold my MIL warranties on her two year old Camry she put maybe 3,000 miles a year on. We settled on $500 to get out of each deal. MIL has no mobile phone and her apartment phone now blocks everyone but friends and family.

There are sharks everywhere.

We are currently sueing my dads ex girlfriend. Dad had a stroke with some brain damage. After a month in the hospital he was cleared to go home. For some reason they stopped at the bank and put the girlfriends name on dads accounts. Then dad had another stroke a few weeks latter, more damage. Business and property’s were put up for sale and proceeds placed in girlfriend account. Also CDs were cashed out, in cash. Then she booted dad out of the house and had his vehicles titled over to her.

Dad has no idea that this was going on or at least no memory. And we assumed he still had money and was being taken care of. Now he is in a nursing home but doesn’t qualify for aid because on paper he still has some money in one of the joint accounts, which is currently frozen.

So we have a court date in a few months and are burning thru $3,600 a month for his care. And lawyer fees.

I'm hoping that the trust Cindy & I recently set up would prevent this.

Gotta be a special place in hell for predators like these.
