Matt, refusal in NJ means your guilty. But then you might get a chance to cut a deal with the prosecutor. In my case, since I was very nice and friendly to the cops, they wrote a nice note about me on the report, which made the prosecutor offer me a sweet deal. In VA, I'm pretty sure refusal cannot be used as evidence of guilt and certainly not as proof.
