Intent. You "broke the law" in the first sentence of your orignal post.
Throughout your mortgage application there will be little checkboxes which you will initial. These checkboxes/initials will be the "catch" come time to face the music.

Nonetheless, he still has to pay off the original note. That doesn't disappear into thin air.
