Dymag is out of business
Dymag is not out of business! See my other post. However, I will not be using the *******s at Paypal any longer. A seller can be totally unethical and if 45 days go by, you are screwed.
and Paypal stiffed me on my deposit because it had been more than 45 days. I'm not using Paypal any longer and plan to file in the small claims court here in TN just to make them show up with a lawyer and pay the SOB. Last edited by Lentz; 11-13-2014 at 11:32 AM.. Reason: See my other post. |

Did Dymag file a bankruptcy? If so, you need to file a claim with the bankruptcy court. Without getting into the priority of claims, the general rule is "First in time first in line"... Small claims would be if the company is just stiffing you and is still in business. They won't bother with a lawyer. And they won't even show up. You might get a judgment, but so what. How much cash?

Are you sure about that? Nothing on their website and Facebook page. I called the US importer and he knows nothing of them going out or business either??
I ordered my set thru Orient Express. Took 11 weeks to get them..... not the 3-4 weeks as advertised. Drop dead gorgeous and impossibly light ( just under 14lbs out of the box! ) Last edited by Milepost; 11-12-2014 at 10:52 AM.. |

Paypal has the ability to charge back to the vendors account. The amount was not so large that if I brought suit against Paypal and represented myself that it would be worth it to them to hire a lawyer.
I actually had a pretty good case in that they modified their contract with me through course of dealing by charging back one other charge after 45 days and then failing to notify me of the change in policy. A judge is king in his own courtroom and a local judge would have certainly have ruled in my favor, I think. That's even if they did show up. They might then win on appeal (maybe not though) but it certainly wouldn't be worth the legal fees. I might or might not have gotten court costs and cost of them being served. My argument was weak there but I would have been out probably only 300-400, not half the cost of a set of wheels. I handle all of the contracts for my company, although I'm a CPA and not a lawyer. |
