2010 Mini Cooper S Hatchback. Went to change oil/of course took out transmission drain bolt like a fool. lost about a quart...Here come the questions:
*Its an R56 that does NOT have the CVT Transmission correct?
* Is it possible overfill pipe broken because seems to want to keep draining...
* Does this transmission drain pan even have an overflow tube?
* then when I started mini transmission fluid was seeping from T55 fill hole...I really thought I tightened it enough...any ideas lost another quart...

Correct, no CVT.
Anything possible, but why would be it be broken? Without impact I don't see why that would be.
it has a fill tube for checking level.
I would need to see the hole you are referring to, to be sure.

Get transmission to operating temperature and then refill with proper synthetic fluid. Were you performing a routine service or was there a slippage issue?
