a possible Ebay issue

Hello everyone I may ....... repeat I may have an issue with an item I submitted a bid on . Had an itch for a Porsche watch and have been looking in various areas on the net . Found one on Ebay and sent the seller some follow up questions . All questions were answered in a timely manner . Based on the ad description and the answers to my questions I submitted an offer . That offer was accepted . But after the offer was accepted I get an email from the seller stating much of what is in the ad is false !!! Stated she did NOT put many of the details in the ad ............ someone ( ? ) else did ???????

So I sent back an email reply just now stating I made the offer based on the details in her ad and the answers she provided via email . I told her now that my offer was accepted it puts me in a bad position , if I don't pay I will get dinged with a bad rating . I don't buy a lot from Ebay but my reputation is my reputation . The two major sticking points are the type of watch mechanism ( battery/self winding/mechanical winding ) and the brand of watch . The ad clearly stated the watch was brand X and now she say's it is not . So while I wait for her reply what recourse if any do I have . The amount of money is not large as it was being represented as " worked when it was put into storage "

Retract your offer. You can do that since the description has changed.

Thanks for that but apparently you can't retract after the auction is closed . I tried and received this error massage : " Offers cannot be retracted after the close of an auction " . The seller/Ebay closed the auction when my offer was accepted .

Seller should be able to cancel the transaction. I've had to do this when I broke something I had sold while en route to the post office. I dropped an oil temp gauge before boxing it up, bent the needle.

If seller won't cancel, contact ebay with the issue. They should be able to make it right. Include sellers note about false info on ad.

Really hard to ding a buyer on ebay anymore. I had a bad experience with a buyer and wasn't able to leave negative feedback for them. Maybe things have changed since this happened?

As others suggested, you can cancel the transaction due to inaccurate description. Just include the body of the message they sent stating the information was incorrect when cancelling.

Am going through something like this now. Not eBay. I sent payment and the next communication from seller is a contract which absolves herself of accountability for her representation in print. Conveniently, she claims she is married to a lawyer. Wtf?

After payment? WTF is right. I'd demand an immediate refund for changing terms, and notify/cancel with credit card company.

Depending on the dollar amount I would have sent her a message stating if the item isn't as described, you might need him to do some work for you

I sold a pair of vintage Florsheim Cordovan Imperials oxfords..i listed them as 9 D..when I went to sell them I noticed they were 9 E . Contacted buyer with option to cancel. He canceled refunded money no harm no foul.

Thing was I had a pic of the size 9 E marking in the shoe and size measurements. He did not completely read the description nor look at all the pics. This guy is an attorney for a national.labour relations law firm?

About the only out would be if they add "we have described the item to the best of our ability. Buyer is responsible for verifying item is as described prior to purchase". Not on eBay.
All the buyer has to say is not as described or damaged...and they get their money back plus shipping.

The seller is responsible until proven innocent..and you have to fight with them to prove it..ask me how I know..

I have argued with them so hard and with such lucidity that one of their senior it guys is a follower of my account.

Btw they record all the conversations..

I wasn't referring to ebay. The person I responded to clearly stated their transaction wasn't on ebay. On ebay... you are correct.

Richard, just contact eBay using their form. They will take care of it and probably place a 'time out' on the seller. If a Power Seller, they can lose their status.

With spoons the buyer has a 3 day right of recession..they lose shipping.

With auctions it is mostly you buy it you own it..if in doubt don't bid..

I dropped 27k on two spoons at an auction in Australia sight unseen. I sold one of them later to a guy in Holland..he paid the expenses of a guy to come and eyeball it and xray the barrel.

Sorry I was outside doing yard work. Seller replied to my email and said she completely understands my reason for cancellation . She said she is going to contact eBay. If I don't hear anything by COB tomorrow I will contact eBay .
