NICS background checks

Apparently, gun sales have been shooting through the roof this year. So much so that even the FBI’s National Instant Criminal Background Checks System, commonly abbreviated as NICS, has been getting a little bogged down.

Reuters recently reported the following on the increase:

“A surge in people buying guns since the coronavirus pandemic began has flooded the FBI’s background check system, causing a spike in the number of delayed checks and allowing gun sales to proceed without them, FBI data disclosed.”

According to reports, there’s been a 54% increase in NICS being delayed over three days between the months of March and July of this year, when examining the numbers from 2019.

To get a good understanding of the gravity of this increase, keep in mind that a NICS report is intended to take a matter of minutes. Now, there are cases – obviously – where the report might not take mere minutes.

So, those reviewing NICS data are afforded three days to locate and information that would bar someone from purchasing a firearm.

However, if no determination is made on the NICS report within that three-day period, then the gun sale is allowed to go through.

Not so if buying from Cabela's.
:(

It's been over a week for me, getting a CCW is also slowed down at the County level. 2 weeks to get an appointment to just submit an application. 3-4 months to get one.

A call to Cabela's corporate in Missouri finds that this is NOT corporate policy. Stay tuned.

Joe, aren't you a former LEO?

Joe Bob 04-08-2021 04:10 PM

If after 10 years from retirement and you don't have a current CCW, no dice.

Also, CCWs from other states, even if reciprocal are no bueno.

They are liars

I'm one that has waited as long as 4 months for papers to go through and 7 days for a NICS check. It may be counter to policy but I wouldn't want to be the one that releases a weapon on day 4 to someone who shouldn't have one.

I don't play in NFA land, but imagine waiting 6 to 24 months for permission to take your gun home

With a few million people out there owning what today was reclassified as an SBR, if they have to go through the NFA process to make them once again legal, the wait will be several years. Though I predict next to no compliance. ATF will make examples of a few people, but otherwise, those guns will just be kept out of public until the political winds change again.

An e-filed Form 1 takes 30 days or so currently... and I've been pondering it to do a SBR. But that whole "don't invite the government into your life", etc. thing is slowing me down...

If it takes a long time for you to get your background check, then somthing in your past might have popped up. The reason for the spike in sales is Civil unrest, criminals being let out, and wide spread fear...and now they are nipping away at your 2nd amendment rights, and defunding the police.

Wow, and I thought it was a PITA when the Typhoon came it, and even with my CCW, it was a day later before I could pick it up.

All the more reason to just build your own. ¯\_(ツ)_/¯

Bull****.

This is just the gov't machine laying groundwork for very long wait times.

berettafan 04-09-2021 12:23 PM

My last long gun purchase took seconds. And that was just a couple weeks ago.

Yeah, no way in hell they are letting sales go forward without a background check

Depends on what state you are in (some states use their own check, some use the fed check) and what else is going on in that state. I've bought 2 within a few weeks of each other. One done on a wednesday took about 3 minutes to process and come back clear, the other done on a Saturday with two big gun shows in the state going on plus a couple of smaller ones took almost 24 hours to process and clear.

That is my experience as well.

I consider myself a responsible gun owner but I don't see any common sense in this new Tennessee law . Am I off base ? I see nuts and mental cases taking advantage of this .

I am a strong supporter of a training requirement as well as background checks, but I am aware of how easily those can be made onerous. If they are made reasonable requirements I wouldn't be opposed to their enactment.

eg. training in a two day / 10-12 hour total course in handling and safety would be fine for owning and additional 1 full day training in carry and holster use for open carry.

Yes, you're off base. Lots of states have Constitutional Carry, meaning the Second Amendment is all the permit you need. If you can legally own it, you can legally carry it and don't need a gov't. permission slip. We've had it for 11 years in AZ. Can't recall the last time someone abused it, and it would certainly be in the news if they had.

FWIW, I just bought another gun today at a dealer. No NICS check. Paperwork took about five min. because ATF told them their electronic version was no longer valid.
