After watching the video, I'd like to know how wide the shoulder next to the cement barricade is. Sure didn't look like plenty of room, or a safe place to pull over to me.
Yes, it would be wise for the state or whoever to settle out of court. A sympathetic jury could decide to award more than the punitive damages being asked for.

She could have stopped, and should have stopped when the cop kept moving around her to the side to indicate stop now..

But the moron with the flashy lights should have figured out there was no car chase, and saw the hazard lights and think there could have been an emergency of sorts and take a wait and see approach..
There was no reason to PIT, she wasn't racing away or endangering others.

All her lawyer will do it emphasize pregnancy and that she had some kind of medical reason for not stopping right away like pregnancy low blood sugar or whatever

All he can do is shut up at that point but that won't help him cause the lawyer will then discuss both scenarios and ask the question why a 27 year service is unable to imagine appropriate situational awareness and appropriate response to a car that isnt' speeding, has turned on the hazards, and is making no aggressive movements to shake or evade the cop car

The lesson many ill take from this is ...pull over, even on a narrow shoulder and let LEO take their chances with oncoming traffic. If the shoulder is narrow enough LEO will need to approach from the drivers side.

I would say pull over. Don't the cops have a PA to say keep moving to a safer spot? Still no need for that stunt IMO.

I was stopped in Loseranna in the '90's mainly because I had CA plates. The two cop cars that pulled me over only offered that they have suspected CA drivers of smuggling drugs. They did what was a 'ransom' search and found nothing. By ransom I mean they told me that I didn't have to give permission, they would just call a tow and impound my truck. Then search.
