Not sure what your rules are but here buildings and trees are different, buildings (including overhangs) must be at least x.x feet away from the property lines, trees can be right up to it and hang over.

Here in CA a tree fell over the property line and the owner whose land the tree was planted on paid for the fence and clean up. I know. It was my dad's tree and I had cut a trench near the roots for a gas line to his pool heater. A windy storm came up before the roots could re-establish.

Talked with my son last night , the GC is coming up with a few solutions and getting back to him . So for now it's wait and see .
