Who's at fault?
 
One spouse pulls a car out of the garage, stops just outside and puts down a "box of stuff".......then runs inside the house to get something.....

The other spouse gets in the other car does not look behind the car before starting up. Entry by this spouse to the garage is from the inside the house not outside the garage door, and backs out squashing the "box of stuff".....

Who is at fault?

I will tell you who "I" was later..... to be on topic, it involves an SUV and my SC cabriolet.....

Hmm, that's a tough one, but I would go with the person who put the box down being at fault. Yes, I guess ideally the person should have looked behind the car before they backed out, but the one with the box should have thought about where they were putting the box and eliminated the possibility, but hey, hind sight IS 20/20, everyone makes silly mistakes from time to time.

Oh, and my guess is you shouldn't have put the box behind the SUV. ;)

No really, I don't think you should put a box of "stuff" down behind a car when it is not usual for for the person to see behind the car (like in your example, when they come from the house).

Depends on what the box of "stuff" was! But as John so aptly put, "just say yes dear, I'm really stupid". I should have known thru my extra sensory powers that you put the box in the driveway.

OK....I guees I'm the *********.....but what if you factor in the fact that this is first time "I" put something behind the SUV and my lovely spouse has backed over other (fourtunatley) inanimate objects in the past?

Another car and a suitcase for example.....


BTW, MY box of stuff contained liquid polishing compound, wax and touch up paint....the polishing compound was the only thing that got run over and it squirted all over my freshly waxed and polished car....not to mention white compund on my BLACK convertible top..... just glad the paint didn't get crushed.

NO WAY! the person driving the car is ultimately responsible. anything can be in the way, even stuff that moves under their own power. cats, kids, stuff like that. you always have to make a pass around the car to make sure. way better safe than sorry. so i vote against the spouse driving. my humble opinion, lucky it was only a box.

The SUV would have cleared the box. So the idiot in the SC crushed the box and is at fault. FWIW.

BOTH are at fault. "Compromise": The most powerful word for marriage! Seriously, in this case I think both parties share part of the blame. You need to either get rid of the box of stuff (e.g. get a shelf) or park your cars in the driveway (like 95% of the CA population) so you can fill the entire garage with boxes full of stuff! :D

PS: Just for the record: I have 2 cars in my 2 car garage! MY cars. My wife parks on the street!

Nah...whoever was backing up is at fault...cou/da been a small child or pet there just as easily. Got to look before you back up.
