Juror #5 Dismissed.

Yes, this is the same guy that was conversing with Laci's brother while going thru security in San Mateo last week. The replay of the incident sounded like discussing "You're going to lose today". The juror said he said "You're going to be news today".

The Fox news analysis said the 'lose' was what was said.

THEN>>>>>

Juror #5 admitted to his girlfriend that he was really disappointed in the media coverage of that incident.

Haha, she goes to the judge, and relays this, knowing that Scott Petersen's life is on the line. He was sequestered for a reason. To not discuss the trial with ANYONE, and to not view any press accounts of the trial. Ooops.

The judge calls him into chambers, and he admits this, while his (hopefully ex-) girlfriend is there.

The judge dismisses him, and an alternate is placed in his seat.

THEN>>>>>

Juror #5 goes before the media, and says "Scott Petersen is innocent" if he had to vote today.

He is writing a book as we speak. Autographed copies will be on sale at eBay before the week ends.

Justin Falconer (juror #5) is on Court TV as we write, talking about the case.

Says "Somebody needs to show me how a pregnant woman would have fit in THAT boat."

Says "No way a good looking dude would have spent 4 days with that hmmm, you know, that girl Amber when his wife is home alone."

Says Scott "really wanted to get that new toy boat out. Fishing wasn't necessarily the reason to go to Berkeley on Christmas Day."

Says that if "he had a side fling going on, he would have been freaking if his wife disappeared. Scott was making up stories about golfing and stuff, to just keep people from finding out about Amber".

Says "he was removed from jury panel because he was 'distracted', and he wouldn't have wanted himself on this jury if he was on trial".

More jewels to come, I am sure.

When reminded that the defense attorney showed the Martha Stewart tape of the meringue show, referenced by Scott Petersen as a part of his memory of the days prior to Laci's disappearance,

Jason says "Boy the prosecution took a butt whippin that day."

Says he totally dismissed the yoga instructor's testimony cuz "Laci was not as immobile as she said she was cuz she was out walking the dawg, right???"

Says "So you're telling me that Scott took a dead Laci out in choppy waters and tied anchors to her and dumped her from this tiny little boat, and if you can't prove that, then he is innocent no matter how he acted afterwards. No matter what Scott says."

Yep, he admitted that he was smiling at Scott's family every day as they arrived. Said it was tough to do because Laci's family was even closer to him than Scott's family.

This guy is amazing.

What a zoo. Court TV is running live. They are zinging him nonstop.

The key question is whether we have another OJ jury here or this loon was the only guy not paying attention.

I heard a radio interview with him immediately after his dismissal, and he was more equivocal on the guilt/innocence issue.

Maybe he saw more money and press opportunity in taking a more pro-Petersen stand.

For those of us out here on the left coast following this case, it seems very open-and-shut. Cheating guy murders wife. End of story.

The thread of the talk shows this morning does seem to be the same as the OJ tial.

The OJ murder seemed so open and shut. The prosecution fumbled the case and he walked.

As you say, Techweenie, the Petersen case seems so open and shut. If this juror is any indication of how the trial is going, the prosecution is fumbling the case. The defense has not even opened their rebuttal yet! All the jury has heard so far is the prosecution present their case.

Does not look good.

Was just mentioned in another thread that prosecutors work for the state, and defense attorneys work for the profit.....

That the talent follows the money.

The prosecutors have to earn a name for themselves in order to become defense attorneys...

The burden is on the Prosecutors. They have to prove beyond a reasonable doubt.

The defense only has to prove that there is any doubt.

How do you figure? No witnesses. No DNA. No murder weapon. The coroner cannot even conclude that she was murdered.

Do I think he did it? Sure. Will all 12 of the cheese-brain jurors? Doubtful. Give me a couple hours with a jury and I know I could create "reasonable doubt" about the sunrise. Peterson will walk.
