Oh right, Len. The agreement says they can use the image for any business purpose, and you'll trust that their use of the image will not disappoint workers. Yeah, and you can count on them to forego profits where the business venture might have negative consequences for workers and the public. Ummm, I've got some real estate available at prices you'll find very attractive.

techweenie 08-10-2004 08:46 AM

I've been doing promotional materials for companies for 30 years. I've never required anyone to sign a release in perpetuity and without 'valuable consideration.'

I believe the motives are other than a 'promotional' use. Employee monitoring is more like it.

lendaddy 08-10-2004 08:46 AM

Huh? You feel that a 1/8 page shot of you at your desk in a tri-fold flyer is going to be held against you if the company turns Enron or something? Ohhhh to have so little to worry about.

Decolliber 08-10-2004 08:53 AM

Just make sure they don't WANT to use your photo for promotional pruposes. When you see a camera, make a wide idiotic grin, or yawn, stuff your cheeks with cookies ...

Get in writing that you will be fired if you don't sign -- or at least in e-mail.

ditto.

I like the email idea. Send'em an email sheepishly asking 'do I haaaave to sign this?

Then have a copy sent to your lawyer, for review. . .that could take a while. Then ask for clarification on the verbage. Then ask if company has any business interests in supporting gay voyer porn sites. Then ask if they have a lesbian one too. Then ask if . ...

I hereby release (i) the Company, (ii) any of its associated or affiliated companies, (iii) the Company’s directors, officers and employees, (iv) its agents, (v) its customers, (vi) its vendors and contractors from all claims of any kind on account of such use.

"HI, I'm John Edwards, partner here at Edwards and Schiester. Did a former employer use your image or likeness for promotional purposes without giving you fair compensation? If you answered yes, I can recover hundreds of thousands of dollars for you! Just listen to one of my clients"

"Hi I'm Lamar Latrel, when I told John Edwards that McDonalds had my picture in a promotional shot of employeeof-the-month, he was like cha ching!, he got me $560,000 and I can't thank him enough!"

"I can make your dreams come true as well, just contact Edwars and Schiester and we can do for you what we did for Lamar."

island911 08-10-2004 09:14 AM

Yeah, that is pretty absurd. I imagine that the absurdity level would actually dillute it's effectivity in a courtroom (don't know thou').

My guess is this is more a piece of paper that says; 'don't whine if we record you . . .you've been warned' . ..something they can put back in the employees face wiht "see, you signed this."

Shuie 08-10-2004 09:21 AM

Damn, my biggest concern was being asked to sign a non-compete agreement. That's ridiculous.

Will they let you wear these if you sign it? :)

island911 08-10-2004 09:27 AM

:D good one Sherman.

That's like saying;
"I see your contempt . .. and will raise you with humorous-contempt' :D

Mule 08-10-2004 09:30 AM

Changing the agreement is an option, did it for a friend of mine. If thay let you take the agreement with you to sign it you scan it , modify the text enough to cover your a$$, sign it & give it back. If the $hit ever hits the fan, they will give the agreement to a lawyer who will read it & explain to them that they are screwed. Worked like a champ for my buddy!

Schrup 08-10-2004 09:45 AM

Mark, are you concerned that they'll capture you peeing in the company coffee pot on video?;)

Moneyguy1 08-10-2004 10:30 AM

Wayne...THey should ask permission in the first place, and then tere is no problem..

But that is just too logical.........

Mark Wilson 08-10-2004 10:38 AM

Again, I don't necessarily care about the use of my image while I'm under the company's employ. This agreement is very open ended and gives others outside of my employer rights that I don't agree with.

Maybe; but, by shoving a one-sided legal "agreement" in the face of their employees, with (or w/o) implied "or else!" . .. it seems to me that this is a company working in bad faith. (that is never good for a relationship.)

Mark Wilson 08-10-2004 11:07 AM

The relationship has been decided. I just discovered that termination papers are being drawn. I have no choice at this time except to sign the document. Really pissed.

nostatic 08-10-2004 11:10 AM

you guys have obviuosly never seen a model release agreement. The ones we use are equally as draconion. We reserve the right ot use their image in perpetuity in all forms of media.

Why? Becuase we are a new media research center, and we can't predict what form might come next, and we don't want to be hamstrung by trying to secure releases in the future. Our caveat is that we specify that we only use for non-commercial use (although promotion is OK), and we don't license to other entities.

But this is standard stuff.

lendaddy 08-10-2004 11:11 AM

Mark,

I would hate it as well. My dentist begged me to be in one of his promotional deals after a bunch of work. I said he didn't have enough money.

That being said, I really wouldn't worry about it, just be aware they are watching you from here on out. Perhaps they've had some theft problems or something. Either way your only there for a while.

Shuie 08-10-2004 11:11 AM

Thats BS. Sorry to hear this, Mark. This is the kind of **** that makes me dread looking for another job.

Good luck
