FWIW, this is why working for a small/family owned company can be good. Sure the security is potentially less, but your freedoms and respect levels are much higher. These big ass companies cannot be blamed for protecting their aasses in this letigious society. Big money=big target, just ask Lamar:)

I do not share the optimism of some of you. And I feel a little vindicated now that the company is playing hardball with Mark. The thing that worries me the most is that Island's last post seems to agree with me. Hmmmmmm.

And no, I do not think the purpose of taking images is marketing. I think it is discipline.

And finally, I also don't think this is all about litigation and suing deep pockets. I think it's about discipline, and technology as a substitute for good management.

Welcome to lassez faire capitalism.

And by the way, with all due respect to folks who believe the company's actions are restrained here (unfortunately I think I may be disagreeing with my hero here, Techweenie), there is a little doctrine in play in our nation called "employment at will," which in essence says that management owns the jobs, not the incumbents. And that management can hire and fire at will, as long as they do not violate someone's human rights (racism, etc). They can fire you because they suddenly do not like moustaches. As long as they don't admit it's because you're black. Unless..........

You have a labor agreement.

lendaddy 08-10-2004 12:48 PM

Wait a minute.................you mean I have the right to employ or not employ someone at my will?!!!!????? Sweet goodness, that's insane! What has this world come to?

lendaddy 08-10-2004 12:54 PM

Man I gave it some more thought and your scenerio makes it sound like people start businesses for [gulp] their own motivations rather than to employ the masses!

Seriously, "At Will" employment is a way of avoiding litigations as well. Many companies have this right in the contract so that when Laurie isn't doing her job and you fire her for this, you don't have to prove to a judge that she really wasn't. I mean if anyone knows if she was doing her job it would be a judge. So now, most companies won't even tell you why you're fired for fear of having to "prove it" to a third party with no knowledge of the situation.

Hey, I understand where you're coming from. But it cuts both ways. Here's part of where I am coming from: A colleague recently collected wage monies for a worker. The worker was a young, single, soft-spoken woman with no husband, two little boys, clean but not well-dressed. She had been fired a few months ago and had not found work. She and her boys were hungry, and grateful for the monies. You see, the employer had been working her 50-60 hours per week at minimum wage with no overtime rate for hours over 40. She was fired when she declined his offer of sex.

So you see, as long as someone is running a business with integrity, everything's fine. And from your perspective Lendaddy, everything is fine. but everything is not fine, Lendaddy.

Dr Wilson: You need to get a job at a public university, where everyone from secretary on up to full professor has tenure, and cannot be fired for anything less than mass murder. And most faculty do not need to worry about the university using their photo for promotional purposes, because it would scare students away or at least expose them to ridicule.

If he was not paying her for OT and she did not sign an agreement waiving the pay he is F'ed. Proving sexual advances is tough, but the OT thing is written in stone.

Superman 08-10-2004 01:35 PM

Sure, the OT thing was cleared up in less than a day. My colleague is good at his job (stay out of Tacoma Washington if you're going to screw minimum-wage workers).

Handling the OT issue did not solve the woman's problem, or the problems of the other workers who will go to work for this predator. Many companies are predatory. Not necessarily sexual. Just like we do not blame lions for killing, we consider the above story to be a kind of smile-smile, wink-wink, gentleman's game. I'm sickened. And I guess that makes me a detestable liberal. Right, Mul?

Mark, maybe a government job? Then you & super could become political soulmates?

Does the document require a signatory witness? If not have someone else scribble some doodle in the sig area. Its not like anyone is going to check it against your regular sig.

Its kind of hard to be obligated to a document you did not sign. That's how I got a job that required me to sign a crappy non disclosure / non compete agreement that would have barred me from doing any IT work for anyone else in the tampa area for over a year.
