A company sues because he mentions their name in an ebay sale? That would be like Porsche suing one of us for using the word "porsche" if we were to auction a 911 on ebay.

The guy IS an idiot if he pays. I'd have called the lawyer and told him to tell hartge to f*** off.

If I read it right, this shole thing happened in Germany.

And, I gotta tell you, the laws are very different there. I ran ads in Germany for a client who made software for IBM PCs, and the attorneys told me I could not use "IBM" in the ad. Their 'comparative advertising' rules are very, very tough. This fool essentially compared what he was selling to the Hartge product -- a huge no-no in Deutschland.

However, beating up a private party seller will hurt them more than a $1,000 Euro fine.

Plenty of folks on this board have gotten 'lawyer letters' from Porsche, and one L.A. area vendor had his inventory raided and siezed for not complying with Porsche's trademark rules.

That's the world we live in, now.

Seems it will probably cost them more thatn 1000E to try and get the money...and I would imagine they would have to prove damages as well.

I'd get an attorney and let Hartge try.

Let me get this straight. If I sell a used Hartge (in this case) airdam as an individual on Ebay, Hartge can come after me for using their name in the ad?

Or is it if I sell a bootleg using their name?

Or both?
