Its relative to the time and place. Remember, when the framers of our Constitution banned cruel and unusual punishment they were specifically trying to ban Drawing and Quartering of people as punishment.

To me, torture is an inconclusive - I can argue one man's torture is another man's mere inconvenience, no matter what the Geneva Convention or anyone else says.
Torture for me, for example, is a roomful of kindergartners on holiday cupcakes. The problem in this conflict isn't necessarily who is being tortured and by what means, but who sought to absolve the U.S. from torture, which is all but admitting that it is going on. And that person is your vice president, Mr. Cheney.
