I have to say I've thought of this, too. While OBL was planning his attack, all three branches of our government were preoccupied with stains on a dress. How silly that seems now that we look back.
Certainly, the republican conrgess had something better to do. But at least in a post 911 world they are focused on the really important stuff.. like the college football BCS!

One of the primary reasons for a civil service is for continuity of government function with only minor regard for who is in the White House. Many branches of government, I've worked for several, care very little what the
chief executive says, orders, or wants as long as they get their piece of the money pie, or a bit more. Their jobs don't change much, their performance in the day to day routine stays the same, Bush or Clinton.
The FBI was relatively stable for the last thirty or so years, task wise, and in fact saw increasing numbers, and increasing budgets all during the Clinton years. As an aside, Clinton added about 2500 (net) armed federal agents throughout government each year he was in office, at least for his first term.
Yet, when their colossal failure to protect America occured on September 11th, 2001; there was no price paid by them, or any other government agency that shared at least part of the blame for the failure.
What we must look at now, in my opinion, is the performance of the federal government after 9/11, including congress and the judicial branch; most know of the continuing failure of the Bush Junta.
I think we must give both the congress and the judicial branches a capital
F for their performances in passing grotesquely unConstitutional laws, which Bush joyously signed for the extra power it gave him; and the judiciary for not ruling them unConstitutional in toto. The late William Renquist even reiterated the thinking of all totalitarian courts when he trotted out the latin phrase that means,
in time of war, the law is silent."
It seems to me that all genuine Americans need to work diligently on getting the federal government under control and obedient to the law; and cut out
our team vs. your team childdishness so strongly encouraged by various party hacks, particularly those on talk radio.
