911 rod: The insurance follows vehicle here. As far as the throttle. I have never been on a sled with one like that. I was actually using the conventional throttle on R handle bar. Luckily he had a lock on the left hand one, I was squeezing it but nothing happened. If it wasnt locked this thread would not be here. This happened about 1000' down the trail at the first turn I encountered, which happened to be a 90 degree turn. I am not a hill climber, pretty flat relatively around here. Stolen part...well Insurance fraud is a bigger deal than this.

I am waiting to here back from him on my latest offer, $500 plus his deductible. He still thinks I should take care of the whole bill as he is going to look into his legal options.

Unfortunately I need to get my stuff in order in case this happens.

Legal options? Consider not paying him anything. What an asshat.

Ask him for his insurance info so you can file a claim of your own.

If he is going to sue you, you shouldn't give him ANY money. It'll come out during the course of the lawsuit. But I would counter sue for your medical bills, time off work, your personal equipment, etc....

This is not going to be good! But if he sues you I don't think you have anything to worry about. The lawyers, judge whatever will just make you pay his deductible. That's what you were willing to do anyway. But, it may be a wash with your lawsuit over your expenses.

In a world where insurance companies make the rules, suing someone doesn't necessarily carry the same pejorative connotations.

A branch from our tree fell into our neighbor's yard, doing some damage to a fence and an outbuilding. I immediately called my insurance company to file a claim. They said, no, he has to file a claim with his insurance company or, if he's sues me for the damages, then they'd pay for it.

It's just part of the process, nothing personal. What a f'ed up world we live in...

Before I get slammed. I just want to clear up my last post a little. I don't think you should get a walk or even benefit from this. All I was trying to say is that you should pay his ded and his insurance company should take care of the sled, your med bills, etc. All the expenses for both parties.

Dont buy him a replacement. If you do he most likely wont give you the wrecked one (he'll claim the replacement isnt as good). Even if he did give it to you it's likely he'll stop paying on the note. If this has a lien and is a titled vehicle you have no right to it.

The deductible plus a little more for his increased premium is fair and more than is legally required.

Well here is the tree anyways. Thank god it dsnt have a little plastic memorial next to it.

No news yet. I think, hope, he is just taking a little time to let this whole thing sink in. His sled is to him what a lot of our pcars are to us. I dont know him real well, but for a younger guy, I am giving him the benifit of the doubt on him being a "good" guy.

They are both experienced riders and each own sleds.
Not a lot of side hilling in MN. The mod is done in the rockies, not the midwest. The guy is a knucklehead, and not much of a friend IMHO.

Glad you were OK. A local kid was killed in the MI UP around the same time you had your crash.

Don't be fooled, this dood is not your friend, buddy, compadre, etc. He is trying to take advantage of the situation. He's got two strikes against him, the past insurance claim and the negative equity on his loan. He is counting on you to bail him out on both accounts. I would not even communicate verbally with this guy anymore. CYA, keep it in writing.

So what your friend is saying, is that if he had totalled out the sled himself he wouldn't have filed a claim with his insurance company, right? He would have simply wrote a check for $7000 to buy a new one. NOT! He would have filed a claim so fast it would've made your head spin. And he would've happily paid the $1000 deductible.

But now he's got another option - let's take advantage of my buddy. He can buy me a new sled and I won't need to submit an insurance claim either. The classic double-dip!! Some friend ...... you owe him the deductible and that's it.

Bingo! What he said. You can go a long time thinking you know someone until a situation like this happens, then you really find out. I'm surprised that more stories like this do not exist around here w/ people letting others drive their 911s on the track. (Where insurance is if-fy).

Standard "Pottery Barn" agreements are OK but should be mentioned up front, preferably before you hear the crashing sounds.

that's why i don't touch other folks toys unless i can afford to cough up the damage with no more then 4 months salary minus the usual budgetting(rent, food).. and i don't let noone touch my toys unless i know for fact they can do the same...or if it's insured to the full value, and no drop risk
