. . .and now the big question; does a state have the right to make it's own laws?

Well then, with some notorious liberals' new found support for the opinions of church leaders, this should be a non-issue, right?

No abortions, no divorce, and no adultery. In a perfect world that is how it should be. In this imperfect world, we should say go and sin no more.

Seems to me if every state did this except Nevada, Nevada could recover some of the funds lost through Indian gaming.

I think that just about anything which poses to cause such tension between the states can be consided a bad thing. We had one civil war already, lets not repeat history. The union shall prevail.

Hmmmm.... I and a co-worker argued this topic during the elections. This country essentially elected into power a government against abortion. My co-worker voted for this regime mainly becase he is NRA and wanted to keep his guns. (The media kills me)
One of his weekend lays called him 2 months late and the first word out of his mouth was Abortion. She miscaried so it was a non-issue. Now States are voting in anti-abortion laws as predicted based on the platform of the current leaders and we cry foul? Why? This is what the country wanted and voted into power. This is what Mr. Bush stood for, morals and religous beliefs that things like abortion are wrong. Myself? Anti-abortion, pro-choice. I personally do not approve but the day the government can decide this for you based on morals is the beginning of fearful times where they will tell you how to worship. I'll make my own choices thank you.

It seems like it's the Federalism of states deciding their own social-moral law or having the feds do it.. kinda like gay marriage.
The big pic, imo, is that this was a legislative decision unlike some judicial decree. It's the voters who are in control not some wacky judge. If the voters don't like the state law they fire the legislators and hire someone who does support the voters.

I think it's great they had the courage to do it. It's time to put up or shut up for these guys. They got elected on the basis of these policies and their apologists cry and moan about how the "liberal press" would tear them apart if they actually enacted any of them. They should go all out on a Federal level and cut social programs that they whine and moan about too. Let's have forced prayer in school, etc. Let the people see who they've elected and if that is what they want. Have some balls, GOP.

This could very well be the only thing bush gets right in all of 8 years. It does have a bit of the smell of Harriet on it though and I'm looking forward to the debate, especially how it will split the Republican Party.

To be clear, co-worker was a NRA member, Republican, church going, moral man, and as soon as he knocked up his weekend toy he screamed Abortion!!
Be careful what you vote for, it might bite you in the ass.

Shaun, just what does Bush have to do with any of this? This is at the state level, remember. This is state government in action. It will be interesting to watch this one travel through the courts during its innevitable challenges. It may withstand those challenges at least until it hits the district court level. I bet it eventually gets struck down, by a Federal court that has no jurisdiction whatsoever. Anyway, this should be fun to watch.

I'm as right wing as the day is long and I couldn't care less about abortion politics. It's just amazing how people get so worked up about something that will never, ever affect 99.9% of them. So what if SD bans abortion? It's guaranteed to become a SCOTUS case. If they let it stand, some other states might ban it too, but plenty never, ever will. I have a hard time believing someone will not be able to get an abortion because they want one. If VA bans it, just hop on the Metro and go to DC or MD. If PA bans it, just go to OH or NJ or MD. If NV bans it, just go to CA. What's the big deal? Worst case scenario is the woman/couple have a 3 hr. drive to an abortion-legal state and can spend that time thinking about her/their decision. If all the pro-choice whiner groups spent a faction of their money paying for travel to abortion-legal states for women who wanted/needed them, we might be able to get on with more important debates. Abortion never should have been a federal issue and Roe v. Wade was an abomination. Congress will never ever ban abortion, but states should be able to do what they want.

Jeff, I think it will stick, and hope it does.
On the question of bush, well, I simply believe he's behind the move. Sure it's a state thing, but you gotta start somewhere in overturning something like Roe. This strategy also fits well into bush's "create an enemy to push legislation/agenda" style.
