Question Weird divorce legality question.

I have never been through a divorce so I have no idea of the legal ramifications so here goes.
True story:
My friends wife leaves him to have a lesbian affair (they have since gotten back together) she was gone for over a month so the idea of divorce was kicked around.
Question #1
If you can prove your spouse committed adultery does that put you at a significant advantage in the divorce proceedings (they own a house)
Question #2
Is a woman having a lesbian affair considered adultery?

This should be interesting

and yes our kinky friends have already suggested threesomes however my friend is very conservative in that area.

But seriously you legal eagles out there, if she left him to go live with someone else would he get to keep the house?

they in CA? If so, adultery doesn't make any difference in the divorce settlement (from a legal standpoint). It's a no-fault community property state.

Same in NJ.
The only negative effect a can see would be with custody of kids. He may have a case that her lifestyle and possible abandonment shows she lacks as a responsible parent.

No difference - but it really depends on the state. California and Florida are pretty similiar as far as that goes.

Pretty sure the 1st ex Mrs JeremyD went lesbo a go go after the divorce... If she would have brought a friend over earlier we might have figured out a way to make it work...

In CA (and Florida) my only advice would be to just sell all the crap and split down the middle. Not worth fighting over values of stuff - the lawyers just get rich off the effort.

we've used a mediator. Pricey, but a hell of a lot cheaper than each of us getting our own lawyers. Should be less than $5K for everything. But it only works if both sides will play well together...

That's the key - but you never know with divorce - it's a wildcard. Ours started out amicable - we went to mediation. Then she quit her job and decided to go to school and have me pay for it.

So let me get this straight (pun not intended) if she left to live with someone else and it came to a divorce they would split the house?
