That's social convention, not one's First Amendment rights. As you've claimed before, you have no limits on speech except when under oath. Brooks and Sumner were in the wrong, but Sumner didn't hurt anyone.

Your link claims it was the event that sealed the rise of Republicans to major-party status. So if Republican aggression caused the Civil War (in your worldview), Brooks indirectly caused the Civil War.
