ducati was totalled friday

So on friday my brother took his yellow 2000 ducati 900ss out for a ride with a buddy with a R1. A 20 yo girl pulled out infront of them sideways in the road, they didnt have enough time to avoid it ( she was sideways blocking the whole road) so his buddy went right into the fender and over the hood. my brother on the other hand locked up the brakes went endo and both him and the bike went into the side of the car. Luckily they were doing the speedlimit. His buddy got off with some serious road rash and with all of the adrenalin got up and started cursing the girl out. my brother on the other hand couldnt stand as he had fractured both his shoulders and seriously got the wind knocked out of him. both were taken to the er and my brother was admitted to the icu. the guy on the R1 was discharged from the er. So now he's in immense pain and having trouble even getting out of his hospital bed. Insurance said it was 100% the womans fault and they will be going after her for the bike and all of the medical bills but just to be safe we have contacted legal help. first lets hope he heals up nicely and second do any pelicans have any legal advice as a next step

Man, what a shame. Hope everybody recovers, and quick. I stopped riding a long time ago, not least because of things like this. I came to regard every driver as a homicidal maniac who was looking for me.

Sorry to hear. I've been almost killed twice (literally) on road bikes. One time I was given the Last Rites at the Catholic hospital they took me to. Both times I was in ICU for a week or more. Both times were the cars fault. One turned left right in front of me and I t-boned him, the other time I was at a traffic light and got rear-ended and thrust into cross traffic. I won't ride a bike in the big city ever again. Open country roads when I "retire" out of Los Angeles, to Arkansas or something, maybe.

cop gave my brother a speeding ticket while he was in the er for "speed unsafe" even thought he wasn't there to see it and there were no skid marks to measure. I believe my brother when he said that he wasnt speeding. the other woman never even got a ticket

I ride ever day, would like to think I have something of a sixth sense for avoiding trouble but perhaps am just whistling in the dark. Hope they both make a full recovery.

My hopes to your brother for a speedy recovery. I was hit by an inattentive driver last feb on my bike but made it with far less serious injuries. I hope your lawyer takes the stupid at-fault driver to the cleaners. An attorney is worth every cent.

Your brother should be able to beat that ticket in court. I do about 800-1000 miles per month on my bike. The stuff I see out there on a daily basis just lowers my already very low view of most people. I need to get that cell phone jammer in my tank bag.

I was hit on my bike and the first thing I did after getting out of ER was to retain a Lawyer that specializes in MC stuff. It took almost a year to recover the medical costs but it is the best way to go to come close to getting made whole again.

Your brother should do as E38 did and retain a lawyer who does motorcycle accident work, for the motorcyclist. The insurance company will protect its own interests, which are whatever it has to pay for bike and medical. It has no interest in your brother's loss of wages, pain and suffering, deductibles and co-pays, long-term injury or disability, rehab, etc. The fact that the policeman wrote that ticket suggests to me that the girl, or her parents, are "on the ball" here, have a lawyer, and are going to fight.

There are MC specialist law firms around here. They advertise on the radio and on some websites. I'd find one of them.

most likely the lady has $100,000 max per person / 300.000 per accident per claim (hopefully the standard insurance policy) once you (or your friend) retain a lawyer they'll take 33% or a 1/3rd of that...........so, most likely, if he had PIP and good medical insurance, medical bills covered, forget "mental pain and suffering" and the rest be thankfull he's still alive, even with the limp and shattered bits.

I don't ride much, but I'm a cagey MFer when I do. I hate stopping at a light, when a car come up behind me, I'm ready to squirt out of the way. SO many people hit stopping at traffic lights and the person 'just didn't see them'.

I'm glad the guys are alive. Hopefully they have a full and speedy recovery. I'm appalled that tickets are given in this sort of situation without any evidence. I guess the theory is they should have looked, anticipated the girl pulling out and been slowing down "just in case"?

I get enough pleasure and satisfaction from riding that I'm willing to take the risks involved. It's not congested here at all compared to where I started riding. It does wonders for my mental health, as opposed to sitting in a cage and all the frustrations that come with that.
