Is this a crime or just an A**hole?
 
My neighbor is a dismantler/service/pig. I've never gotten along with him for several reasons but this tops them all. He saves all his dirty oil in five gallon acetone drums he gets from the body shop next door and then instead of paying for waste removal he sets them in the alley and waits for the city to come clean it up. Go over there late night some night and throw them over his fence, make sure you hit a couple of his customers cars...Rinse, repeat...He will stop doing it in short order.

"What Standards Should My Business Follow?

If your business generates or handles used oil, there are certain good housekeeping practices that you must follow. These required practices, called "management standards," were developed by EPA for businesses that handle used oil. The management standards are common sense, good business practices designed to ensure the safe handling of used oil, to maximize recycling, and to minimize disposal. The standards apply to all used oil handlers, regardless of the amount of the oil they handle. Although different used oil handlers may have specific requirements, the following requirements are common to all types of handlers. These requirements relate to storage and to cleaning up leaks and spills, as follows.

Label all containers and tanks as Used Oil.

Keep containers and tanks in good condition. Don't allow tanks to rust, leak, or deteriorate. Fix structural defects immediately.

Never store used oil in anything other than tanks and storage containers. Used oil may also be stored in units that are permitted to store regulated hazardous waste. Tanks and containers storing used oil do not need to be RCRA permitted, however, as long as they are labeled and in good condition. Storage of used oil in lagoons, pits, or surface impoundments that are not permitted under RCRA is prohibited."



Looks to me llike the containers are not marked "Used Motor Oil". Other than that looks like he's fine.

I think it is against the law. It should be considered hazardous waste. Report him.

Call the fire department from a pay phone and say that you were wondering why barrels of hazmat were being dumped outside of XXX address.

See how long it takes for them to arrive...

For one obvious reason - the offer of Kevin to pick up your banged-up Triumph in the rain and store it in his shop - and your subsequent dissing of him doing so - would make it so that if I were you, I wouldn't reply to any of his posts.

Besides which, you just gave some very juvenile advice. :rolleyes:

edit: Make sure he isn't calling a service that picks up the oil in the alley. You may be misunderstanding the situation. You don't want to go off half-cocked.

You have no idea what you are talking about...Kevin started throwing bombs my way, for no good reason, long before his offer of picking up my bike...I never dissed him for the offer, that is ridiculous...To his credit, he did make the offer and I appreciate that.

Now go do what your wife tells you and don't dare be a man and think for yourself, unless she says it is okay.

I've called a couple city agaencies who I thought might be able to do something about it but just keep getting the "It's not our dept" runaround.

Lots more attention as they get the local city guys on and ask what's the deal, and then get the property owners as they run away, hiding thier faces and then the guys in the blue suits come out like Bill Murray squeegeing a Baby Ruth bar off the bottom of the pool and eating it in front of Judge Smails and his wife and then the helicopters start circling the area, taping everything that's going on.....

Well one of you is a liar, and I've known Kevin for quite a while - and I don't make it habit to know liars.

Secondly, I too left my job to drive out in the rain to check out your ****ed-up bike, and chance to say I received no better treatment for the task than Kevin, least of all a "thank you."

BTW: I understand a couple weeks ago that you were on my family's land, in our parking lot, screwing around with someone's pickup truck. Did the sting of dominant liberalism burn the soles of your poorly-baptised feet, little general? At least the pickup is gone, so maybe you gave it a Godly touch. :rolleyes:

Funny thing is back when I threatened to kill the ferrel cats that infest the parking lot, I was threatened with a visit from PETA and "Actors and others for Animals" and it only took a couple hours for some bleeding heart cat lover to get here and make sure I knew I was being watched.

Oops, thought it was on his property.

Other than being improperly marked (and being on public property) there may be a problem with the oil mixing with acetone residuals. It is then considered under a different set of (Hazardous waste) regulations.


(b) Mixtures of used oil and hazardous waste—(1) Listed hazardous waste. (i) Mixtures of used oil and hazardous waste that is listed in subpart D of part 261 of this chapter are subject to regulation as hazardous waste under parts 260 through 266, 268, 270, and 124 of this chapter, rather than as used oil under this part.
