FastPat, did you hear?
Nifong is under (or will be under) review by the BAR for his actions per the Duke (non-)rape case.
Sorry if this has been posted. PS: I know I have a thread by a similiar name, but VBul. broke itself last time and you can't read the thread....

I did hear that, and more. Nifong is under criminal investigation as well it seems.
Sadly, defending themselves from the predations of Nifong's taxpayer funded witch hunt hasn't been cheap. The good news is that there is a Legal Defense Fund. Quote:

Joe,
Never, and that's the real tragedy of the whole debacle. A couple of bright, ambitious young kids had their reputations ruined irreparably by some fame hungry scum sucker on a witch hunt. No amount of money could ever buy their good names back, because there are some things people just don't forget. These poor guys are going to have that "rapist" stigma attached to them no matter how much it's proven they DIDN'T do it; negative impressions never seem to truly go away, and the doubt will linger always in the back of society's collective mind. I hardly ever feel bad for the plights of others, but man does my heart go out to these young men.

They won't recover what they had before the phony accusations and false arrest. Fortunately, both Duke University and Durham county will have to pay, most likely, and pay a lot. All legal fees and punitive damages wouldn't be enough, but it's a start.

He's in a world of hurt right now. It's just mind boggling what he did. Every prosecutor's office has a rule that you have to try the cases you charge; if you're not comfortable trying the case, don't charge it. That's a good way of keeping overly aggressive prosecutors from over charging cases and then dumping them on someone else in the office when the going gets tough. So he knew he was going to have to see this one through to the end.
Even more, there are rules that say that prosecutors can't make public comments about pending cases. From day one he raised m eyebrows with his aggressive press conferences. And what he said in the press conferences just painted him into a corner. He just went on and on about how there was a gang rape, it was a slam dunk, he had DNA evidence, it was just a matter of whether he could catch all the bad guys. This is extrordinary for a prosecutor. Just think of all the prosecutor press conferences you can remember. If you can remember any, they're usually pretty dry and ammount to something like "We're very sure of our case and we are confident that justice will prevail". After the case is over the prosecutor has a little more leeway, but not a lot. The only explaination I could see for him going so far out on a limb and making what appeared to be unethical comments about an ongoing investigation, was that I figured he really did have slam dunk proof in the form of photos or DNA and his local rules were looser than I am used to. I guess not. All I can say is I am astounded. How did he think the evidence would not catch up to him?

Why was NC so intent on prosecuting this? What did they stand to gain from this, especially with overwhelming evidence the kids were NOT guilty?
I'm asking serioulsy..I really am curious.

He should have known it was over when the mother of one of the accused looked right in the camera and said, "Mr. Nyfong, you picked the wrong family to take on." Should have folded his tent right then. |
