In Vermont, like many other states, speeding at 90 mph + (or 30 mph over the limit) can get you jail time.
"No person shall operate a motor vehicle on a public highway at a speed of 60 miles per hour or more and at least 30 miles per hour in excess of a state speed zone or local speed limit. A person who violates this section shall be imprisoned upon a first conviction not more than three months or fined not more than $300.00, or both; and upon a second conviction shall be imprisoned not more than six months or fined not more than $500.00, or both."

probably a hell of alot less than our very own wunderboy senor jorians FAILURE TO APPEAR FELONY, in oregon,U.S.A.
amazes the hell out of me how you can expect to get away with excessive speed or for that matter a FAILURE TO APPEAR. which all ends up in, at the least, a suspended license, if not jail wherever you go. just read article about this local clown who was busted for FAILURE TO APPEAR and DRIVING ON SUSPENDED LICENSE here. they are both FELONY STOPS, which means you WILL HAVE A GUN(pick flavor and caliber) POINTED AT YOUR HEAD, when cop, more likely plural cops, pull you over. this local guy, had local judge, throw the book at him, and then the entire LIBRARY AT HIM! he'll be lucky to sit behind the wheel of any vehicle in any state for about 5 years! aside from doing mega jail time,insurance going into next solar system, and the fine. you wanna haul ass..............better be real smart in a rural area or go to the track. montana and the stretch btwn vegas and reno are about the only places where i know you can light 'em up for a little while, before applying brakes! cops are not STOOPID! out of 35 people in my last NAU class, over 85% were cops working on their degrees! |

What's the relationship between a driver having a failure to appear, a cop pulling a gun when someone gets caught speeding, and an erroneous presumption that cops are stupid? I don't get it.
It scares me that there are still cops out there without anything more than high school educations, a gun, and a badge regardless of how stupid or smart they may or may not be.

there really is nothing you can do except judge mandating ignition drunk meter on vehicles. happens all the time here. guy gets DUI, license suspended, gets in other car or borrows someones car and drives drunk. for suspended license, only recourse is severe jail time and fine. but still happens.
be it known if you fail to appear on ANY TICKET, it becomes a FELONY STOP! and cops HATE FELONY STOPS UNLESS THEY HAVE LOTS OF BACKUP! a FELONY STOP AUTOMATICALLY gets you the EXALTED STATUS of go to jail, do not collect $200 dollars and a GUN POINTED AT YOU! a FELONY IS A FELONY, no matter how trivial it is to you. cops treat it as pulling over ghengis kahn,hitler,tojo,pol pot, lee harvey oswald, the devil and o.j. simpson all wrapped into ONE! in ariz. anything over 85 and its up to discretion of officer to throw you in jail. period! after 86mph you have committed a FELONY! and they will treat the stop accordingly. ie. BIG GUNS POINTED AT HEAD AND BACKUP WITH BIG GUNS ROLLING TO THAT LOCATION! remember they always think 'better safe than sorry"! was out riding dirt bike one day years ago on non deeded dirt road (county). doing about 50-60 mph, when all of a sudden i hear siren! WTF! i grab brakes on XR, downshift and pull over. next thing i know i have (2) sheriffs pointing GLOCKS AT ME! down on the ground face down and then CUFFED! stated to me "arent you kinda old for riding dirt bikes?" and i answered "yes, why did you pull me over?" they replied "we have had alot of dirt bikes stolen here in the last couple of months"." and we thought it was stolen". so as you can see, they dont take anything lightly! |

Are you sure you weren't in a police state when that happened? While I don't doubt the veracity of your story, the fact of the matter is that you shouldn't have a gun put to your head in this country without a good reason and simply riding a dirt bike in an area where other dirt bikes have been stolen certainly doesn't qualify.
I hate to derail this discussion and I very rarely sound off on these off-topic discussion type dialogues, but the way you seem to accept that sort of routine by the police is frightening to me. The police are there to protect you first. That is their role. Their role is not to draw guns at any arguably appropriate opportunity as a way to show force or intimidate an otherwise law-abiding citizen.

One of my nephew's little buddies was clocked at 141 on a motorcycle last year. He was arrested at gunpoint also. Lost license for two years, had to pay $1500 in fines, $500 to victim's restitution fund, 100 hours community service and an eventual remedial driver's program at the community college. He got to keep the bike, though.

Funny, I've had a policeman drive past me while I was exceeding 100 mph and simply wag his finger at me. I slowed to the posted limit, knocked on wood, thanked my lucky stars, and headed to 7-11 to buy lottery tickets.

I can see all of penalties imposed by the court as acceptable given the speed of 141 mph. Now, unless he was wanted for a violent crime and the officers who pulled him over identified him as such, please tell me why he was arrested at gunpoint for speeding. You can hurt someone going 75mph on an interestate just like you can going 141. I'm not saying it's smart, but I don't see how once you've stopped and you're on the side of the road not going anywhere there is any need to heighten the seriousness of the situation with guns and the big show of who's boss.

It's pretty common, anymore, especially if the cop thinks you are blatently disregarding the safety of others. Older cops I have known bragged about how many years they had served without ever unholstering their sidearm. Newer, younger cops may be trained differently, plus they've been watching 'Cops' on TV for the last fifteen years also. Those shaved heads and 'dietary supplements' probably aren't making them a whole lot calmer, either.

Joe, you see things much like I do. It's terrible but true.
The problem is that even if the officer perceives you to have been disregarding the safety of others, that risk is obviated by the simple fact that you've been stopped. No more speed - no more risk. Cops aren't in the business of punishing or judging people. Thus, if a gun is pulled as some sort of "this is what you'll get" tactic for being caught speeding, it doesn't jive with the reason why you got pulled over in the first place, i.e. jeopardizing others by being (arguably) out of control at such a high rate of speed. It's just an abuse of authority, plain and simple.

i guess i was an "outlaw" dirt biker with jersey stating my name was "MOOSE"(another long cop story involving (4) of us held at gunpoint by armed female dyke forest service ranger on top of sierras above lake tahoe one july 4th)!
my bike didnt have plate on it, and that was reasonable cause. i did get ticket for riding on non-dust proof surface and no motorcycles license. yeah i know, how the hell are you going to make the dezert "dust proof" and why did i get ticket for no license riding on non-deeded road in county. i was nice to cops, signed tickets, then pled not guilty to judge jacque mcvay n.e. justice court phx. to make long story short.........my day in court came, and i appeared pleading not guilty. the honorable judge jacque mcvay, never allowed me explain my side of story. i was smart enough to go get motorcycles license before court. after showing her proof of m/c license she proceeded to fine me $153 dollars for the "non dust proof " ticket. i was pissed! well years later after hearing many rumours of the honorable mcvay being intoxicated on the bench here, and other asundry faux pas, she was forceably removed from the BENCH, a few months ago, by the az. supreme court ! there is KARMA! man if there is one thing i learned when i was younger and has been reinforced by going to school with cops..................DONT EVER DITCH A COP! and i cant count how many we ditched when kids on mini bikes and our 125's. they LIVE FOR THE CHASE! what we did daily as kids w/dirtbikes WILL GET YOU KILLED NOWADAYS! mantra at age 49........... i only drink beer at home. i dont ride dirt bikes anywhere there are cops. i dont haul ass on highways. well kind of??? i only haul ass at the track! note to anyone attending THE FBR OPEN-the phx. open golf tournament. a special DPS and city of scottsdale DUI HUNTER-KILLER SQUAD is out in mega force for the 500,000 estimated goofy golfers attending the event. freeway 101-scottsdale road-bell rd.-frank wright blvd.-pima roads will BE SMOTHERED IN MARKED/UNMARKED CARS and BIKES! avoid area at all cost unless you have tickets to attend meat market BIRDS NEST PARTIES! take a taxi home................new law passing the capital to make fines and jail terms stiffer than they already are! and they are DEATH ON DUI'S HERE! |

Unfortunately, not having a licence is not reason enough not to drive.
We (Canada) have very lax laws (no death penalty....short jail terms) for almost everything. I observed a car thief after the trial that had given him 6 months of house detention (with ankle bracelet) as he exited the court house he went across the road to the parking lot and stole a car to get home! This was his 16th offence (the trial) and he was still on the street. He has been chased so many times in these stolen cars I have lost count. My next door neighbor has not had a licence in over 10 years (DUI) but still drives ...and drinks and drives....gets pulled over....goes to court....drives home. There has to be a reckoning somehow. Why can't we just shoot them on the side of the road? No repeat offenders. Bob

well jorian, you have crawled out from under your rock! that truly is a goal you should yearn for. i was nice in OT and gave you some advice that may help. but alas you want to continue the "i'm better than you-richer than you-smarter than you-blah blah crap"
so tell us have you learned anything about the american judicial system? have you figured out where your new home will be if you enter the U.S. as a FELON? have you contacted ICE yet? if you CANT AFFORD AN ATTORNEY, one will be appointed for you! have you realized how much time you will spend sorting out your FELONY- FAILURE TO APPEAR WARRANT? and MONEY! have you figured out what your going to do when your canadian drivers license is suspended? the nice thing about u.s. federal jails is how well they treat people. ie. you will be offered kosher food/vegi foods/ or other ethnic foods so as to not trample yours rights! have you explained to boss/co-workers/family you may show up MIA for awhile, until things are sorted out? funny how someone who is a FELON wants to play smart a$$! now kiddies just ask jorian the great why its expedient to take care of speeding tickets in the united states despite being a pompous canadian who feels hes more impotent than others/smarter than others and doesnt have to abide by the laws of the land in which he is visiting! heres the ONLY difference btwn you and me jorian...........................YOUR A FELON and upon entry into the UNITED STATES you will be classified as a "ILLEGAL ALIEN FELON". and i'm not a FELON! as a matter of fact i'm a CCW holder in the state of arizona who had his clearance to enter PROJECT MERCURY, NEVADA, SANDIA LABS, WHITE SANDS MISSILE RANGE, LOS ALAMOS LABS and all military bases in the southwest, right up to the yellow line on the tarmac of the runway ie. standing right next to F-117's at HOLLOMON A.F.B.! also i'm a current rated USCG crewmember, just short of my coxswain rating in the UNITED STATES COAST GUARD AUX. so i know a little bit about immigration laws/search and seizure on the high seas etc. i could be called upon in the event of a natural disaster or attack and board the u.s.s conifer u.s.c.g. cutter based in san diego as a crew member. so back to topic before we were so rudely interrupted by a FELON! it pays to ....... A) not get caught speeding. B) appear in court on your happy day to appear. C) pay your fines in a timely manner or....... D) be like jorian, fail to appear in court, fail to pay fine and have license suspended in canada by long arm of U.S. LAW and suffer the expense/time of being better/smarter than everyone else, all the while jumping into enjoyable posts and starting crap! man i wish i could be a FELON LIKE JORIAN! better yet an ILLEGAL ALIEN FELON! truth hurts dont it buck-o! |
