During the course of this saga I have repeatedly offered to allow a judge to be the arbiter over whether or not my video material has any evidentiary value. (04-03) 15:33 PDT SAN FRANCISCO -- Josh Wolf, the blogger whose record 7 1/2 months in federal prison stirred debate about who qualifies as a journalist and what legal protections they should receive, was freed today after releasing video footage sought by prosecutors about an anarchist protest.

Wolf would not snitch, and posted the video for the whole world to see. Looks like the politically driven (or career driven) prosecutors backed down after a federal magistrate got involved.

Wolf posted the uncut video on his Web site, gave prosecutors a copy and denied under oath that he knew anything about violent incidents at the July 2005 protest. In return, his lawyers said, prosecutors agreed not to summon him before the grand jury or ask him to identify any of the protesters shown on his video.

Prosecutors' withdrawal of their demand for his testimony was the key to the deal, Wolf told reporters outside the prison gate. .

Since there's no federal shield law, journalists should not be exempt from having to comply with a judge's order to turn over evidence. Some states have shield laws though and there's talk of a federal one coming soon. But I don't know why anyone thinks journalists have more rights than the rest of us. I can't defy a judge's orders with impunity. Why should a journalist be able to do so?

Second Amendement rights are....well...relative.
