The Big Cat take a hit...
My bride is wondering if she should involve a lawyer. The kids are unscathed. The wife was a bit battered and bruised. And she's really hurting today.
Fate reared its ugly head yesterday. My wife and my two children got hit by a Toyota running a red light. After we made it home from the E.R, I looked the Jag over. It took the hit well. The Toyota hit the right fender (wing), damaging he front suspension. (It only looks okay in the photo.) The hit was hard enough that it spun the Jag around until the quarter contacted the Toyota again. The Toyota is definitely totaled. I'm thinking the Jag can be repaired. IMO, it depends if she has lasting injuries or not. If it's just a temporary thing, why bother besides trying to win the lottery?
I'm on a diminished value kick... you can ask to be compensated for lower value of your now that it's been wrecked. A wrecked car is worthless than a never wrecked car when you try to sell it.

Without hesitation! Soft tissue injuries are serious. Especially for a mom who is constantly bending, kneeling, carrying kids etc.

Hope all will be OK. But driving a Jag is the best in any crash, glad she had one because they are built like a rock wall.

I'd say sign no releases for a spell...let the M.D.'s (plural) check her out, see how it goes. Could be just a soreness that will pass, or it could be serious.
Sorry about the Jag...Neil pegged it on "diminished value"...another factor in why I no longer drive a valued collector car...the absolute paranoia that somebody would prang it. There is peace of mind when driving a low cost appliance...

Screw the car, how're she and the kids doing?
I know it sucks, but at least they're still above ground. Before going the lawyer route, give them a chance to make it right. First sign they're not playing fair, then laywer up with a reputable barrister. No ambulance chasers. Who's the OP insured with?

Glad your family is ok.
How do you determine diminished value and what are the insur. co's obligations there? I'm going through the same thing now. I've rear ended twice in the three mos. and am pretty sure Carfax will not be kind to my car when I try to sell.

Rick, sorry I didn't answer on your post. You will need an appraiser to write a report for you. It worked great when State Farm was giving me grief when someone backed into my 911.
Go here for more info. He is local to me, but I am sure there is someone in VA who can help. The fact that someone else hit you might be a problem, but it's worth a try.

Its fantastic that the kids are ok, and the wife is seemingly without permanent injuries. I'm sure a lot flashed through your mind when you heard there was an accident, and it was a relief to find out they were all ok.
CONSULT a lawyer. You may not end up actually pursuing anything, but keep your doors open and don't close any. I don't think people here are suggesting you go the lottery route, but rather be in a position to get what you need if it turns out that its needed. This is 'merica, and you need your lawyer. |
