Angry Help! Mom's in trouble.

She rented a room to a law student He put a stop payment on this Months rent check and ran up a $140 phone bill(phone was off limits), which he refuses to pay. When he refused to leave her den(off limits), she called the police. They could do nothing because she was not threatened. They knew him well and said he has had problems in several other places. We went to Civil court to file an eviction. The trial date is 6/16 and then he gets another ten days to vacate. Meanwhile he lives there free and is eating her food, etc, etc, etc... We are worried for her safety and I can't stay with her in V.A. for a Month. How can we legally get this guy out???

Pisses me off just reading this.

DO make sure you get every scrap of personal information about this SOB you can. You don't need to touch someone to hurt them these days.....

EDIT: If it were me, he probably would already have had a gun stuck in his face and his ***** thrown out on the lawn at this point. Nuthin' makes an instruction like "Leave NOW" stick better than the fresh imprint of Glock barrel on your forehead.

Have your mom live at your place for the month and
1) turn off her utilities and phone, or
2) pay a couple carefully selected goons who hate lawyers to live there as "house sitters", or
3) pay someone to be there whenever the A-hole is there to play deafeningly loud accordian music non-stop, or
4) ......anyone?

Got to play this one carefully. His brother and father are lawyers in C.A. They are probably supporting this freak. Otherwise I would have brought the beltsander and salt. Mom has a gun and knows to call 911 if threatened but I hate to leave for business back home.

+ bone up on the law where your Mom Lives. CA renter's law is absurdly in favor of the renter, so find the differences in the law from the two states and exploit them to the fullest.

You are definately going to have to check the landlord/tenant laws in your state or perhaps county.I am in california and I am sure the laws are different. Turning off the utilities and those sort of things are illegal out here.
If he hasn't paid rent he can be evicted.A court date will determine that, unfortunately she will have to wait.
Make sure you have good information on him in case he blows the court date. He will be liable for rent, phone charges, damages and
things like that after the court determines he owes it. His wages can be garnished and he will get an eviction on his record, which will make it harder for him next time.
From my experience out here, there is not a lot she can do. You also can't mess him up a little because he knows where your Mom lives.
But, since he has done this to other people there is a good chance he will never know its you if you wait 3 months.
That is too bad. Is it in the rental agreement that the den is off limits? That would be trespassing.

Like I said, check the laws out there. Maybe he could be tossed out first and then the court determines your Mom was in the right.
But, I if she changes the locks now and the court determines she is in the wrong, big trouble.
Have your Mom photograph everything now and later for the court. It is very helpful in proving damages.

Simple, she fears for her safety, call the cops and get a restraining order, not allowing him within x feet of her, he has to move out.. just like domestic violence cases.. might take a little white lie on her part but who cars.. He did threaten her right ? wink wink

You know, what you could do is offer him some money to move somewhere else and then sue him in small claims court for the lost rent and whatever else you can.
I don't think the judge is going to like this guy very much and your Mom would most likely win.

Okay, I got a phone number to get info on the V.A. laws.
She will not tell a lie to get him out at this point.
This guy has some serious mental issues. keeps a ball of wet toilet paper outside his bedroom door(Off meds????).
Has just been charged with distruction of public property(out on bail).
He is also sueing the local library for $30K(????).
He is a graduate with honors from Berkley.
Is doing Paralegal work by mail for his brother.
He apeals to death each case he loses.

Perhaps the law is different there, but here that would allow the property owner to invoke the Protection of Property Act. I suspect the officer was trying to avoid hassle on his shift, but if she insisted he leave that room (to which he had no right) he could be arrested for failing to comply with a legal order.

I think she should persue that. His behaviors are interfering with her enjoyment of life. If he were housed in a different property, this might not apply (and again the laws to protect the individual might vary) but as he is in her home, she has the right to enjoy that home.

Failing that, perhaps her pistol could accidentally discharge several times.
