'Pain and Suffering'

My insurance guy said I will be settling with the other company.

What's reasonable?

Three weeks after the accident and I still hurt and am not able to work like normal.

I don't buy into pain and suffering for the most part. I think it's largely a BS legal doctrine myself.

I do however buy into real economic losses. Has your pain caused you to lose income? Will it cause you to lose income in the future? What about any hobbies you can't do? How long will you not be able to do them?

I'm one week behind on my current job and I have missed three track days.

I'm not for burning anyone or trying to make a fortune.
I need to be sure that I don't have to pay for any medical issues that arise later.

I doing as well as I could hope.

Keep it open until you are sure you are okay. What do you mean you hurt, exactly? Neck, back, shoulder. What is your doctor telling you about it?

Loss of consortium can be worth a lot of dough too, or so I hear.

How much you gettin' paid for track days?

Do not sign anything until you are certain you are okay

I get 'paid' in track time as an instructor.

I was looking forward to two days at Reno-Fernley. Student drivers paid $495 to run.

I was in a car wreck when I was 17, I ended up settling about 3 months later with what I felt was a fair settlement for my time off work etc. Unfortunately it took a while longer than three months for my neck problems (broke the windshield with my head) to really surface. As the person who was injured you are not in any real rush to settle and I would strongly urge you to take your time and make sure that everything is okay. I am saying this as someone who has worked in the insurance industry for a while and wish I knew then what I know now. Keep in mind I am not saying take someone to the cleaners but I am saying to make sure that you don't screw yourself by accident.
