Of course looking at the past is relevant to sentencing. A person's whole life, and how he lived it, can and is considered. That's why at sentencing you'll see defense witnesses testifying as to how great a dad the person was, how he saved puppies, worked for charities, is an asset to society, etc.

Makes it very tough for the Simpson attys. Who are doing a terrible job so far, but I guess they don't have much material to work with.

There will be the argument that past dishonorable actions not sustained by a lawful judgment have to be excluded from any consideration. Hard to do and I'll bet some will avoid that temptation to a fault.

Not really. We aren't talking about using his past to *convict* him. That's already happened.

It's only sentencing at this point, and it is only a determination as to where in the sentencing guideline he should fall.

He has no past, his record is clean (well, for that incident, I think he had some recorded issues in Miami). When the word "payback" is being used, it is not judicially correct. He should get a hefty sentence from this incident alone (because he really screwed the pooch on this one), but "revenge" or "payback" sentencing is unethical and judicially corrupt.

I know I'm being idealistic on this one, but that's where I stand.

He has forgiven us for this assault on his freedom.

He was found liable in a court of law for the death of two people.

I hardly call that a "clean record."

And, of course you are correct. But, a civil judgment unfulfilled is a problem in my eyes. His record is not clean, only from a criminal perspective. He has skated around his liability by living in FL where homes are exempt from seizure for assets and a few other moves.

If he were going to a fed pen, he would get special "accomdations." In NV, it may be a different story.
