What Is Used In California

Got a call from the State Board of Equalization this morning. It seems that they were trying to sort out a shipment of spoons from Australia back in 2006. Their interest is in collecting the SALES TAX or USE TAX for anything that is shipped into CA and is to be used in CA.

So ANYTHING that is shipped from ANYWHERE in the world that is to be USED IN CA HAS TO HAVE A USE TAX PAID ON IT.

Well LV maybe a criminal town full of criminals but the government of CA sure conducts highway robbery....and calls it a USE TAX..I guess that makes legal

What you can gather from the call is that they are GOING AFTER YOU FOLKS IN CA THAT DON'T PAY UP....

What the SBE lady said was that a guy who had made one small purchase from that shipment got a Use Tax bill from the state for the whole shipment...She said he nearly had a heart attack.

If you display the spoon in a case is that "using" it? Or do you have to eat a bowl of soup before you pay the tax?

I got a message yesterday from an affiliate marketing commission/escrow house saying they were gonna have to start collecting state sales and income taxes on out of state buyers and affiliate marketers because this place is CA-based.

My FFL collects tax on guns I buy from out of state. And I report the actual purchase amount...I don't want them sniffing around and alleging any funny business in the transactions.

Is there a specific reason why all you guys refer to guns as spoons? What do you call spoons? Leadslingers?

Yep - as I recall, we got hit with a used tax when we bought our diesel M-B from Maryland.

Stuff like that makes it hard to lose any love for Cali. And yet I still live here...

How about ebay or amazon purchases, does CA tax them?

According to the lady at the CA State Board of Equalization....ANYTHING for USE in CA has to have a TAX PAID ON IT!....the trick is in catching you

They do not, however people are supposed to "self report." When we make purchases at work that are not taxed the tax is added after the fact by the biz office - we don't want to get audited or hammered by the state down the road.

We're just ahead of the curve, sadly.
