Seems to me that the kid asked for...and deserved and ass whipping... He was not man enough to cash the check that his mouth/actions apparently wrote...and drove over the other man who apparently pointed out what a big-mouthed, spineless pussy he was. I hope he rots in jail.

I was thinking about what many people here have written about what they would do if they caught someone keying or vandalising their Porsche., Here we had a guy who was probably obsessed w/ his clean old SC and he gets in a road beef w/ a little ass hole who then throws something at his car and probably hit it. Imagine if you were already pissed and that just made you snap. I don't see how the guy could have been that crazed unless the young guy did something really egregious. I'm not justifying the big guy's behavior, (he clearly flipped-out), but it helps me understand it. Otherwise normal people can go postal with the right trigger. For him it was the assault on his beloved car. I
've seen a road beef where a guy on a bike spit on a car driver for honking at him and it turned into a full-on roadside brawl. One Swedish tourist, (who looked like a pretty boy), against what looked like the UCLA offensive line on MCs. Pretty boy must have had a black belt in something because by the time I caught up to them, (I saw initial beef/honk/spit), the spitter was laying on the ground holding his head w/ both hands and his buddies were all in full surrender mode while Swede was in a fight stance. I guess being spit on was his trigger to get out of the car against four 200+ lb. tough guys. |

Nobody mentioned this yet: The kid called 911. You don't do that unless you feel seriously threatened, especially if you are partly responsible for the ugly situation you are in. Does this free you of a manslaughter conviction? I don't know. The big guy got out of the car - dumb move. You may be over 6' but a Nissan in the hands of a scared kid (who appears to be no saint either) is bigger ... Just sounds like two guys found one another. Most the time, with two parties involved, one will be smart and back down. If the wrong two people meet, however ... I am not buying the "he was a real calm guy ..." I am reading. Obviously he was calm, but short tempered if provoked. In the end, I think this all came about because the SC guy wished he had a 993 - he would have outrun the rental car. ;) George |

The Porsche guy blocked the Altima guy multiple times, got out of his car and beat on the Altima hood, then again blocked any escape path (unfortunately with his body). What did the Altima guy do? Talk trash?
It's also telling that the Altima driver tried to escape multiple times and also called 911. Those are not the actions of someone trying to pick a fight, those are the actions of someone being attacked. He should get off for this. |
I know NY is nothing like the free states with good self-defense laws. But in states where you are allowed to use deadly force to defend yourself, you're usually covered if you make an overt attempt to withdraw from the fight. I'd say his attempts to escape and calling 911 would cover his butt in many states. Probably not in NY though.
I believe the first test case in TX's CCW law was a road rage incident, where the defense claimed a victim should not have to wait until his last breath before using deadly force. |
well at least the SC was not hurt. this dude sounds like a prick. i used to live close to where this happened. i cant imagine anything like this happening in long beach. if some big dude had jumped out of his car and was acting like he was going to tear my head off, my survival mode would kick in and i would have done exactly what this kid did. perhaps there is more to the story however....

Victim is from Lloyd Harbor, very affluent, the North Shore, LI's Gold Coast.
Kid from Oceanside, South Shore, defiantly middle to upper middle class with pockets of real wealth. If you know anything about LI you'll understand that there are stereotypical "mindsets" associated with both towns/shores that I'm willing to bet had a role to play in how the whole thing started and escalated. Wondering why the victim was in Long Beach. You don't just happen to drive through LB. It's not easy to get to so it's more often than not a destination. If I had to guess I'd say he was at one of the many waterside party bars. Wonder if he had a case of beer muscles. Very unfortunate incident for all. |

What are the chances of someone that large winding up under the car? I've seen countless car vs. pedestrian videos and stills plus had many friends hit by cars and it seems like at least 90% of the time they go up on the hood/windshield or get launched in some fashion. This was some bad luck for both of them. The kid could have at the least stopped moving when the guy disappeared under the front of the car, there will be a "reckless disregard for human life argument" at his trial that may define manslaughter or murder 2 in NYC. (Don't know their laws).

Just within the last month or so we had a similar case in SoCal where two guys were beefing on the side of the freeway and one of them intentionally rammed the other when he was standing between the two cars. (Parallel parked on side of freeway). Killed him, FWIW.
Who stands in front of a car being driven by someone that you are in a fight with??? WTF is wrong w/ people? |
