I got pulled over on friday night at about 11pm while driving from Oxford, OH to Bloomington, IN to visit my friends that go to Indiana. The guy claimed I was going 74 in a 60. I am fairly confident that max speed I had hit in the last mile or so that he could have even seen me was about 70-71. I told him, "Sir I honestly had no idea I was going that fast, I was merely trying to get back to the right lane so that I did not impede traffic." He walked back to his car for a good 3-4 minutes and came back with a warning, I've never had a better experience with the cops.

You don't have to be mean or sarcastic, just answer the questions. Hands on the wheel, do everything he tells you to do.

Until earlier this year, when SCOTUS decided the 4th was just a suggestion, traffic stops were loads of fun if I was the passenger. I would open the door, not say a word and walk away if the cop was a hothead. It drove them NUTS.
Can't pull that stunt anymore. Every stop is considered a Terry stop now and all occupants of the vehicle are considered seized despite an obvious lack of probable cause for the seizure and detention.

That's what a friend of mine says when she is stopped. She does civil liberties cases.

In Oregon, it is illegal for a cop to stop you EXCEPT for an offense.

It is illegal for them to ask you questions also. They are supposed to just give you your ticket and leave you be. But they don't.

If I know I have the time to deal with a long stop, I'd answer it like this:

Do you know why I stopped you?
"No."

Do you know how fast you were going?
"Why did you stop me?" or "I was going with the flow of traffic."

"Lawful personal property." or what I'd really like to say, "Why should an agent of the state know what's in my car?"

Why would you get dragged out of the car and tased? You have to comply with their commands, but that does not include answering a single question beyond letting him confirm your identity and that you're legal to drive that car. If he asks you to get out, do it. If he asks you for a field sobriety test, REFUSE. Do not help him collect evidence against you. As long as you don't physically resist, you're probably not gonna get manhandled. If you think he's out of line, tell him to call his super to the scene immediately. And don't forget the most important thing after keeping your mouth shut - if you're being held up and he keeps questioning you, ask, "Am I free to go now or are you detaining me?" If he stalls, ask again for his super to be called to the scene. Don't ever let him think he has you scared or that he can make you talk to him.

Same here. After awhile my brother and father (both retired LEO) admitted that you have NOTHING to gain by talking to the police...

Because some - NOT all - cops have psychological problems, and like to "assert their authority" i.e. they like to dominate others.

I think the assertion is that some of them go beyond what's necessary to control the situation.

I can't remember any cops ever getting belligerent on me in a stop. I have to assume that lots of these situations may come from the person having an attitude or something (pretty much always only hear 1 side of the story). But, I also have no doubt that there are cops out there that do have issues and overstep the bounds....

Fortunately, I think that those are few and far between compared to the others.

wish i could have had teachers in school that talked so fast and to the point.
maybe i wouldn't ave been bored so much, and actually been able to keep my mind from dozing off all the time.

The point of not admitting guilt on the scene is not to get out a ticket, but give yourself a chance if you fight it in court. If you say, "I guess I was going 78mph, but no way was I going 85." and you're in a 65mph zone, you've admitted guilt and would be wasting your time in court.

my procedure during a stop.

roll down windows, shut off motor, flip on interior lights (at night)..i put both hands on top of the steering wheel. i do not pull out any documentation until i am asked. i kid you not; 50% of the time, the cops ask me, how i knew, or why i flipped on the lights...this lets me lead in with, "well, my brother the policeman told me this helps....". i get a warning.

i dont answer a thing, except, "yes sir", "no sir", and "i dont know sir". never admit a thing.
