Who's responsible?
I recently purchased a Carrera from one of the top dealers of used Porsches. I had a PPI done and everything checked out fine...
I chose to have the car trucked to my house in an enclosed truck. The dealer couldn't line up a enclosed trailer and shipped the car on a flat bed large enough for two cars. The dealer chose the trucking company not me.... After receiving the car I took it to a Porsche shop in my area for a oil change and a good looking over. Upon their inspection they discovered that both of the cars rear lower control arms were bent. Since the scratches to the control arms were fresh they felt the damaged was caused when the car was chained down. [when the car was delivered I did see the chains on the arms but didn't think anything of it] I called the dealer to inform them of the bent arms and they said it was my responsibility not theirs... I called the towing company and they said the bent arms were not caused by them.. I paid $2000.00 to have new arms installed. Am I out 2K or do I sue the dealer? Any input is appreciated... |

Did you have insurance in place before having the car shipped?
I would just go ahead and file a small claims action against the dealer and the transporter to see if/what sticks. |

If your PPI was clean and the damaged occurred after, the dealer or the transport company should pay up. I would contact the transport company and file a claim with their insurer despite what they say. If need be your insurance company can get involved. You typically have 30 days to inform your insurance company after purchase all the while you are insured. I'd try to avoi a claim with your insurer though unless you know it won't hurt your premium.

Yes, the car was insured before transport....to keep my premium costs down I chose a 5k deductible..
Thanks for the input. |

Like hell you should be out $2000. I do hope you saved the bent control arms...... I would go after the shipping company. This is easily a small claims matter. Walk in with the the bent control arms and the PPI report you had done prior to shipping. Seems like a slam dunk to me.

Look at the sales contract.
Does it say FOB on it anywhere? If so, you have been screwed (by the dealer) but the trucking co. is still available. I say sue 'em all and let god sort it out. |

The trucking company would be liable for any damages incurred while in transit.

What kind of *&#%ing idiots strap down a car by the control arms. You would think a trucking company that ships cars would know that is retarded.
